Henry Smith deft:
Sommersett Ss: Henry Smith of this County was summoned to
answer unto Robert Houston in A plea of Debt &c
And whereupon the said Robert for himselfe saith that he
the said Henry became Indebted unto him the said Robt
one sufficient male Servant betweene fifteene and twenty
foure yeares of age to serve at Least five yeares as pr A
Certaine writing here in Cort: produced more plainely will
appeare signed with the hand of him the said Henry
bearing Date the 11th: day of october Ao: Do: 1673 wherein
the said Henry Did Assume upon himselfe and promise
to pay unto the said Robert his heires or assignes an
able servant quallified as aforementioned at or before the
first Day of ffebruary next ensueing the Date of the said
writing; And for the true performance whereof he the said
Henry bindes himselfe his heirs executors: or assignes but he
the said Henry fraudulently intending to Deceive him the
said Robert of the said servant Denyeth and Still doth to
pay and Deliver such Servant The plt: saith he is Damnified
and hath Dammadge to the vallue of Two Thousand nine
hundred and ninety nine pounds of Tobacco in Caske and
Thereupon brings his suite &c ~ ~ ~ ~ ~
