of Trespas upon the Case &c ;
And whereupon the said Mathewe Stevens by his attorney Edwd:
Jones saith That they the said John and Morgan became Jointly
and Severally Indebted unto him the said Mathew in the full
and Just quantity of foure hundred forty foure pounds of good
sound marchantable Tobacco in Caske being due to him the said
Mathewe for severall goods & marchandizes that they the sd:
John and Morgan did take up of him the said Mathew as pr accot:
here in Cort: produced more plainely will appeare for the wch: goods
they the said John and Morgan Did Joyntly and Severally assume
upon themselves and promised payment but they the said
John and Morgan Little regarding there promise and Assumpcon
fraudulently intending to Deceive him the said Mathew of the
Aforesaid quantity of 444lb: of tob: in Caske denyeth & Still doth
to pay the same; Although often thereunto required the plt: saith
he is Damnified and hath Dammadge To y vallue of one thousand
pounds of like tobacco in Caske & thereupon brings his Suite &c ; / ;
