the Dominion of y Rt: honr:ble Caecilius &c Annoq Domini 1674
before his Lopps: Justices thereunto Assigned & Authorised;

Sommersett Ss John Markum was Attached to answer
the Suite of Henry Smith in an accon
of Trespas upon the Case ; / ; ~ ~
And the said Henry for himselfe saith That in the
yeare 1673 The said John Did Imploy the sd: Henry as his
Attourney in this Cort: and did Assume by promise to
pay unto the said Henry the summe of Two hundred pounds
of Tobacco of and Caske but the sd: John fraudulently
Intending refuseth to pay the Aforesaid summe of 200lb:
of Tobacco & Caske Allthough thereunto hath bin severall
times Demanded whereby the said Henry is Damnified
& Damadge to y vallue of 500lb: tobacco and Caske And
thereupon brings his suite ; / ; ~ ~ ~ ~ ~
The writt being executed by the sherriffe and
the Deft: being Called doth not appeare neither
by himselfe nor Attorney The plt: saith if
the Sherriffe will See y Deft: forth Comeing y
next County Cort: he will refer proseedings untill
the next Cort: The sherriffe promised to bring y Deft: next Cort:
