by his Attorney Henry Smith Desires the Declaracon may
be read being ready to Averr what is now in Suite att: the
Deft: & Craves an Attachmt: upon the goods Chattles & Creditts
of Wm: Thomas to answer the suite ; / ; ~ ~ ~ ~
Sommersett Ss William Thomas Late of this County was
Attached to answer y Suite of John Winder
in an accon of Trespas upon the Case
And the sd: John by his Attorney Henry Smith saith
That the sd: William became Indebted unto the sd: John the
summe of six hundred pounds of tobacco and Caske for
boate hire to transport his goods over the bay into virga:
in the yeare 1673 but the sd: William ffraudulently
intending refuseth to pay the Aforesd: summe of six
hundred pounds of Tobacco & Caske allthough thereunto
hath bin severall times Demanded whereby the sd: John
is Damnified & hath Dammadge to the vallue of one
Thousand Two hundred pounds of Tobacco & Caske &
thereupon brings his Suite ; pro qued Henry Smith
Mr: Winder & Loving ffrind
Yors: I recd: in wch: you write unto me about yor: pay for
boate hire I Ashure you yor: pay Shall be returned
unto you to yor: owne home if you pleased to have a Litte
patience, I shoulld esteeme my selfe most unworthy if
I shoulld harbor: A thought in my brest to Defraud you
