And the said John by his Attourney Henry Smith
saith That the said Richard most malicious And with
an evell Intent hath Scandilously reported that the
said John upon the 8th: day of September Annoq Domini
one Thousand six hundred seaventy and foure
way Lay him And did violently Assault the sd:
Richard upon the high way the which is altogether
false The said John being then reposed for his rest
in Mr: Revells house whereby he is Damnified
and hath Dammadge in his reputacon to the vallue
of Two Thousand pounds of Tobacco and Caske And
thereupon brings his Suite ~ ~ ~ ~
pro querd Henry Smith
And the Defendt: Richard Shockley Commeth & defendeth
himselfe And puts in this ffollowing writing vizt
To the Commrs: of the County of Sommersett
The Peticon of Richard Shockley Sheweth that whereas
yor: peticionr: Came as A wittnes to the Court & returning
home John Hillyard assalted yor: peticioner upon the
Proprietaryes High way and after Complaynte made
to the Commrs: he thinking to Avoid the Proprietaryes
Suite hath entred an accon of Defamacon against yor:
peticioner ; ~ ~ ~ ~ ~ ~
Therefore yor: peticionr: prayes that the Accon
of Defamacon may be referd till the Proprietarys
