Thomas Davis plantr: deft:
The plt: and deft: being called appeares
The Declaracon read
Sommersett Ss Thomas Davis plantor was attached to answer unto
Robert Hopkins in an accon of the Case &c
And whereupon the said Robert Hopkins for himselfe saith
That he the said Thomas Davis did on the last day of March
in the XXXXith: yeare of the Dominion of the Rt: honr:ble
Caecilius &c Annoq Domini one Thousand six hundred
seaventy and three Assume upon himselfe and promise
to deliver unto the plaintiffe the next day ffollowing being
the first day of Aprill in the yeare aforesaid one yeareling
heifer, The plaintiffe the same Day being the first day of
Aprill demanded the said yeareling heifer of him the
said Thomas Davis; But he the said Thomas Davis fraudulently
intending to deceive him the said Hopkins denyed to
deliver the said yeareling heifer and Still doth The plt:
saith he is Dampnified and hath Dammadge to y vallue
of ffoure hundred pounds of tobacco and thereupon Justly
brings his Sute &c; ~ ~ ~ ~ ~ ~ ~
The Deft: pleades and saith he owes him none &
desires that he may prove it;
