pro quer Henry Smith In A plea of Trespas upon the Case
vers The plt: and deft: being called appeares
William Broadwell deft:
The Declaracon read vizt
Sommersett Ss William Broadwell was Attached to answer the sute of
Thomas Lampin in an Accon of trespas upon the Case &c. ; / ;
And the said Thomas by his Attorney Henry Smith saith
That he the said Thomas haveing Converss with the said
William Did Sell unto the said William one Sute of kersey
Clothes one pare of Sillver buttons the which the said
William Did receive the said goods of the said Thomas
in the yeare one Thousand Six hundred seaventy and one
and the said William Did assume unto himselfe to Deliver
unto the said Thomas the next Aprill at his dwelling house
called Oke Hall one good Sufficient Cowe and Calfe by
her Side with A Two yeare olld heifer but the said William
Little regarding his promise but fraudulently intending hath
not delivered the said Cowe and Calfe with A two yeare olld
heifer whereby the sd: Thomas is Dampnified And hath
Dammadge for want of the said Cattle to the vallue of
one Thousand five hundred pounds of tobacco and Caske
And Thereupon he bringeth his Accon ~ ~ ~ ~
The Deft: pleades and saith he owes him nothing
The Cort: after A thorough examinacon both of the plt: and deft:
and serious Consideracon Doe finde upon regulacon of both
theire Accots: that there is due to the plt: 710lb: of tob: And ordrs: that
the Deft: Wm: Broadwell pay the plt: Tho: Lampin or his order seven
hundred & ten pounds of tobacco with Cost of Sute alias execucon
