pro quer Sam. Cooper
vers in an accon of the Case
John Hillyard deft: The plt: and deft: being Called appeare
The Declaracon read
Sommersett Ss Jno: Hillyard late of the County was attached to
Answr: unto Cuthbert Potter in an accon of the Case &c
And whereupon the said Cuthbert Potter by his
Attorney Samuell Cooper saith that he the said John
Hillyard Did in the yeare of our Lord God One
Thousand six hundred sixty nine Assume upon
himselfe and promise to pay or Cause to be payd unto
Richard Morly the servant and Attorney of the said
Cuthbert Potter the Just summe or quantity of six
hundred and seaven pounds of tobacco being for A
valuable Consideracon in hand received of the sd: Morly
but he the said John Hillyard noe wayes makeing
appeare that the said tobacco was paid to the sd: Morly
the plt: Craves ordr: for the said tobacco with Damages And
thereupon brings his Sute &c. ~ ~ ~ ~ ~
The Deft: ownes that he promised to pay six hundred
and seaven pounds of tobacco to mr: morley And saith
Did pay the same Accordingly & Craves time to prove
the same untill the next Cort: ordered that there be
a refference untill the next County Cort: ~ ~ ~
