Edward Martindale plt:
pro quer Wm: Planner
vers in A plea of Debt
Thomas Wingood & William Planner attorney for y plt: appeares
Jacob Cheltnam defts: Jacob Cheltnam one of y Defts: appeares
Sommersett Ss Thomas Wingod & Jacob late of Somersett County
was Attached to answer unto Edward Martindale
of Bristoll marchant in A plea of Debt &c
And whereupon the said Edward Martindale by his Attorney William
Planner saith That they the said Thomas Wingod and Jacob
Cheltnam Did upon the twenty third day of march in the XXXXth:
yeare of the Dominion of Caecilius &c Annoq Domini 1671
by A Certaine Spetiallty signed with the hands and Sealed with
the Seales of them the said Wingod & Cheltnam wch: is produced
by the plaintiffes Attorney here in Cort: Assume upon themselves
and promised that they the said Wingod & Cheltnam woulld
pay or Cause to be paid unto the said Edward Martindale or to his
heires assignes or Lawfull Attorney the full and Just quantity
of ffoure hundred pounds of good Sound marchantable tobacco &
Caske without ground Leaves or Seconds to be paid to the aforesaid
Edward Martindale or his aforesaid ordr: upon the tenth day of
october next ensueing the Date of the said spetiallty at some
Convenient place in Anamessicks in the said County of Somersett
To the performance of which the said Wingod and Cheltnam
bindes themselves their heires or assignes but they the said
Wingod and Cheltnam Little regarding their promise but ffrau
dulently intending to deceive him the said Martindale of
