64 The Same Day Commrs as afore
Henry Smith plt:
vers: in a plea of Debt: they appeare before y board
Richard Chambers deft:
Richard Chambers Late of Sommersett County was
Attached to answer unto mr: Henry Smith in a plea of debt
And Whereupon the said Henry Smith saith for himselfe saith
That he the said Richard Chambers Did upon the twenty ninth
day of Aprill Ao: Do: 1670 by A Certaine specialty signed with
the hand & sealed with the seale of him the said Richard Cham
bers which is produced by the plaintiffe here in Cort: assume
upon himselfe & promise that he the said Chambers woulld
pay or Cause to be paid unto mr: Henry Smith of Manoakin
in the County of Sommersett in the Province of Maryland his
heires executors administrators or assignes the full & Just
quantity of three thousand pounds of good Sound marchantable
tobacco & Caske Conveniently in the bay Side in either of the
Countyes of Accomack or Northampton in the Governmt: of Virg:a to be paid to y sd: Mr: Henry Smith or his order as aforesaid at
or upon the tenth day of December next after the date of the said
Speciallty To the performance of which the said Chambers binds
himselfe his heires executors: & administrators in the summe of
Six thousand pounds of good marchantable tobacco & Caske; but he
the said Chambers Little regarding his promise but fraudulent
ly intending to deceive him the said Henry Smith of the aforesaid
quantity of three thousand pounds of tobacco wth: Caske which
being often ( ) but he the said Chambers denying? &
Still doth to pay the plaintiffe Sayes he is Dampnified & hath
Damage to the vallue of Six thousand pounds of Tobacco
