Mr: Henry Smith riseth from the board
Henry Smith plt:
vers in an accon of playnt they appeare in Cort:
John James deft:
The playntiffe desires his decla: may be read
wch: is read as ffoll
Sommersett Ss John James late of this County was attached to answer
unto Henry Smith in an accon of playnt &c.
And whereupon the said Henry Smith saith for him
selfe; That whereas the said John James did in Aprill
last in the XXXiXth: year of the Dominion of y Rt: hon:ble
Caecilius by force of Armes as Swords Staves & knives
breake the Close of him the said Henry adjoyning to
manoakin river; And did kill Cary & Convey away
A sow of his the said Henry to y vallue of five hundred
pounds of tobacco & other enormityes to him he did
whereupon he saith he is Dampnified & hath
Dammadge to y vallue of one thousand pounds of
tobacco & there upon brings his Sute &c ; / ;
