vers in a plea of Debt} they appeare & Joyne issue

Sommersett Ss
John Harrison late of this County was attached to
answer unto Thomas Speare in A plea of Debt
And Whereupon the said Thomas Speare by Charles
Ballard his Attorney Saith That whereas the said John
Harrison upon the 7th: day of november in the XXXiXth:
year of the Dominion of the Rt: honble: Caecilius &c Ao:
Do: 1670 did assume upon himselfe to take up Severall
goods of him the said Tho: Speares to the vallue of eight
hundred forty six pounds of tobacco as pr Accot: now produced
in Cort: appeares which he the said John was to pay but
hath delayed payment allthough he promised well truly
& faithfully to pay the same; But the said John his
promise & assumption Little regarding, but fraudulently
intending to deceive him the said Thomas Speses Speare
the Summe of ffoure hundred & Sixty three pounds of the
said tobacco unpaid, whereupon the said Tho: Speares
saith he is Dampnified & hath Losse to y vallue of
nine hundred pounds of tobacco And thereupon brings
his Suite &c. ~ ~ ~ ~ ~ ~
