MARYLAND COURT OF APPEALS 89

Attorney as the Said Isaack Seserson by Robt Gouldsborrough his Attorney
and the Jurors afd being called likewise Came who being Elected tryed and
Sworne to Speak the Truth Concerning the Premisses and having heard
the Arguments Allegations and Pleadings on both Sides and having duly
Considered thereof upon their Oaths do Say we of the Jury do find for the
pi' Therefore it is Considered by the Court here that the Said Willm Aldern
recover against the Said Isaack Seserson his terme then and yet to Come of
and in the Lands and premisses afa with the Appurtenances And it is further
Considered by the Court here that the Said William Recover agt the Said
Isaack the Summe of Ten thousand Six hundred and Twelve pounds of
Tobbacco for his Cost and Charges in this behalfe laid out and Expended
And the Deft in Mercy etc.

Whereupon the Said Isaack Seserson by Robert Gouldsborrough his
Atfney prayd an Appeale to the Governor and Councill which was Granted
unto him he giving Security to prosecute the Same as the Law in that Case
made and Provided requires.

Whereupon the Said Isaack Seserson with William Morrison his Se-
curity Came into Court and Entred into recognizance to the Said William
Aldern in the Summe of fourty Thousand pounds of Tobbacco that the
Said Isaack Should Prosecute his Sd Appeale with Effect or otherwise to stand
and abide the Judgmt and Cost afd as also all Such further Cost as Should
Accrew by Virtue of the Said Appeale

[134] To his Matys Justices of the Provinciall Court

Whereas a Comission was granted att the request of Mary Royston of
Talbott County Widdow bearing date the two and Twentieth day of May
last Past for the resurvey of a Tract of Land Called Cumberland lying in the
Said County Conteining Two hundred Acres and Directed to Major Thomas
Smithson, Capt James Murphey and Mr John Salter or any two of them to
See the Said land resurveyed and to direct the Surveyor in the resurvey of
the Same according to the Ancient Meets and Bounds as in the Patients or
deeds thereof is Exprest and According to the Evidence that to them Shall
be produced.

These are therefore humbly to Certifye that by Virtue of the Commis-
sion aforesd I have resurveyed for the Said Mary Royston the aforesaid Tract
of Land Called Cumberland lying in Talbott County aforesaid in the pres-
ence of the aforesaid Majr Thomas Smithson Capt James Murphey and Mr
John Salter, beginning att a bounded Oak Standing on Irish Creek and the
End of the West North West line of a Parcell of Land Called Clays hope and
running thence East South East one hundred and Eighty Perches to a Parcell
of Land Called forte Ventura and with that Land South South East one hun-
dred and twelve Perches to a parcell of Land Called Cove hall then South
with Cove hall one hundred and twenty perches at which line it falls into
