MARYLAND COURT OF APPEALS 85

himselfe his heires Exrs and Admrs to pay or Cause to be paid to the Said
Clemnt Sale his heires Exrs and Admrs Certein Attorney or Assignes the
full and Just Summe or Quantity of Thirteen Thousand four hundred
Seaventy one pounds of every way Well Conditioned Tobbacco in Cask to be
paid Convenient in Choptank upon the Tenth day of November then next
Ensuing the date thereof, Nevertheless the Said John Salter the aforest Sume
of Thirteen thousand four hundred Seaventy one pounds of Tobbacco unto
the Said Clement Sale according to the Tenor of the Bill afa he hath not
rendered but the Same to him to render he doth deny to the Damage of
the Said Clement 200001 of Tobba and thereupon he brings this Suite.

Now here att this day to witt the Eighteenth day of November in the
Tenth Year of the reigne of King William the third of England Annoque
Dni 1698 Came the Said Clement Sale by Robert Gouldsborough his Attor-
ney and prayed that the Said John Salter to his Deci afd might Answer And
the Said John Salter by Wm [Dent] his Attorney Corns and defends the force
and Injury when etc. [and] Saith that he Cannot Gainsay the Acco of the plt
So brought agc him as afd Whereupon it is Considered by the Court that the
Said Clement Sale recover agt the Said John Salter as well [the] Summe of
Thirteen Thousand four hundred Seaventy one pds of Tobba his debt afore-
said as also the Summe of Six hundred Eighty Seaven pounds of Tobb" and
the defendt in mercy [etc.]

[130] Command was given to the Sherriffe of Kent County That he take
John Salter if he be found in his Bayliwick and him Safe keep So that he
have his Body before the Justices of the Provll Court the Second Tuesday of
May next to Satisfy unto Clement Sale as well the Sume of Thirteen Thou-
sand four hundred Seaventy one pounds of Tobbacco a Certein Debt recov-
ered of him whereof he is Convict as also the Summe of Six hundred Eighty
Seaven pounds of Tobbacco Cost of Suite whereof he was not to faile and
to have then and there the Said Writt Wittness Robert Smith Esqr Chief Jus-
tice of the Said Court the 19th day of November in the 10th Year of his Matys
Reigne Annoque Dni 1698.
