truth he is not named in the Deci but as Leaser but the Judgmt ought to have
been that the PI1 Recover his terme according to his Deci and not the Land,
and therefore Error.

jgthiy T}^ judgment Given agt Robert Grundy is not well given nor
can it bind the right of the Land for that the Said Grundy had not any Estate
or Interrest in the Land either in Possession Reversion or remainder to his
own use, but to the use of the Orphans of Thomas Impey deceased who are
within the Age of One and Twenty Years and whose Estate the Land is and
they by the Law ought to have had their Age, And the plea Ought to have
remained for the Non age of the Coheires and this being not done renders
the Judgment Erroneous.

for all which Errors and Diverse others in the Record and proceedings
as also in the rendring Judgmt and awarding of Execution the Said Robert
Grundy prayeth that the Judgmt of the Provll Court So as afd agt him Given
may be reversed Sett aside, and holden for none and he to all that he hath
lost thereby may be restored.

MARYLAND ss. William the third by the Grace of God of England
Scottland France and Ireland King Defender of the faith etc. To the Hon-
orble Robert Smith Esqr and his Associates the Justices of our Provinciall
Court Greeting, Because that in the Record and Process and Rendring of
Judgment on a Certeine plea of Debt lately before You Depending in our
Said Court between Clement Sale of Talbott County Mercht PI1 and John
Salter of Kent County Gent Deft Manifest Error (as tis Said) hath hap-
pened to the Great Damage of the Said John as of his Complaint we have
recd We willing That the Error (if any be) should in due manner be Cor-
rected and full and Speedy Justice done to Each of the Said partys in this
behalfe Do therefore Command you that the Record and process of the plea
and Judgment aforesaid together with all things touching the Same before
his Excy the Governor and the Honble the Councill att their Sitting to hear
Appeales and Errors on the 28th day of June nex[t] under your hands and
Seales Distinctly and Openly You Send That Inspection being thereunto
had, We may Cause to be done What According to right and the Laws and
Customs of our Kingdom of England and of this our Province ought to be
done in the Premisses, Also that you Cause the Said Clement to be Sum-
mon'd That (if to him it Shall Seem Meet) he may be then and there to
