8o MARYLAND COURT OF APPEALS

respect. We Command you that by Good and Lawfull men of Your Baily-
wick You Cause to be made known to the Said John Rhodes that he be
before our Said Governor and Councill att the Town and Porte of Annapolis
the 3d Day after the End of the Next Provinciall Court to be held in February
next to hear the Record and Process aforesaid if to him it Seem Expedient
and further to do and receive that which our Said Court Shall Consider in
this behalfe and have you there the Names of those by whom to him you
Cause to be made known and this Writt Witness our Trusty and Well be-
loved Francis Nicholson Esqr our Capt Genll and Governor in Chief in and
over our Said Province and Territory of Maryland this i6th day of November
in the 9th Year of our Reigne etc. Annoque Dni 1697:

On the back Side of wch writt of Sci: fac. was thus Endorsed Vizt By
Virtue of the within Writt to me directed. To his Excy the Govr and his
horible Councill within Mentioned I Certify that I have made known unto
the within Named John Rhodes That he be and Appear att the time and
place within Mentioned if to him it Seem Expedient etc. before John Low
and George Hadway Two good and Lawfull men of my Bailywick as this
Writt Exacteth and requireth per me

Robert Grundy agf John Rhodes

Reasons Assigned and Exhibited upon a Certein Writt of Error brought
by Robert Grundy agt one John Rhodes upon a Certein Judgmt Given by
the Provll Court for the Said Rhodes agt the Said Grundy.

William Harris Lessee of Jno Rhodes brought Trespas and Ejectment
Ag* Robert Grundy and Declares upon a Lease made to him by the Said
Rhodes of the Land in Question upon the [123] Tenth day of Aprill 1693
to have and to hold the Said Land to him the Said William Harris and his
Assignes from the last day of february then last past before the Date thereof
for three years and he Setts forth that he by Virtue of the Demise Entered
into the Land and Premisses and was thereof possest and being thereof Soe
Possest the Said Robert Grundy afterward to witt the ioth day of Aprill afore-
said in the Year afd with force and Arms etc. into the Premisses aforesaid in
and upon the Possession of the Said William did Enter and him the Said
William from his farme afd for the terme aforesaid not yet Ended did
Eject etc.

ist It doth not Appear by this declaration when or what time the PI1
Entered into the Land; for if he Entered the last day of febry or att any time
after that and before the making of the Lease in the Deci Mentioned then
his Entry was not Lawfull and Consequently the Entry of the Defendt upon
