MARYLAND COURT OF APPEALS 79

was produced and also taken by this present Jury to be the aforesaid begin-
ning of Cudlington then from the Said Locust post with a Streight Line to
the first bounded Tree of the Land Called Wattson all which Said Survey
may more plainly Appear in the Platt hereunto Annexed, In Witness whereof
the Sherriffe, the Surveyor and the Jury have hereunto Sett their hands and
Seales the Last day of Janry 1695.

Now here att this day to witt the 3d Day of March Anno Dni 1695 Came
the Said Parties by their Attorneys aforesaid and the returne of the aforesaid
Warrant of Resurvey being read and by the [121] Court here fully under-
stood It was therefore Considered by the Justices here the day and Year Last
mentioned that the sa John Rhodes recover age the Said Robert Grundy as
Well the Said Tract or parcell of Land Called Wattson as also the Summe
of Twelve Thousand five hundred Twenty Two pounds of Tobba Cost of
Suite and the Said Defendt in Mercy etc.

Robt Grundy v John Rhodes

Then Came Robert Grundy by Robert Gouldsborrough his Attorney
and presented to the Court his Certeine Writt of Error for the removing of
a Judgmt Obtained by the Sd John Rhodes agt the Said Robt Grundy before
his Excy the Governor and Councill which was in Court read and allowed

H Wriothesley Clk:

[Bre de Error. Sci fa Corrigend.] William the third by the Grace of God
of England Scottld France and Ireland King Defender of the faith etc. To the
Sherr of Talbott County Greeting. Whereas in the Record and process as also
in rendring of a Judgmt upon a Certeine Action in Ejectmt before the Justices
of our Provinciall Court in our Province of Maryland by William Harris

Lessee of John Rhudcs of Talbott County brought for a. Parcell of Land

Called Wattson lying in the Said County agt Robert Grundy Defendt Mani-
fest Error hath happened as is Said to the Great Damage of the Said Robert
as by his Complaint we have received wch Judgmt Record and Process we have
lately for Certeine Reasons Caused to be brought before our Governor and
Councill Constituted a Court for hearing Appeales and Writ[ts] of Error
etc. And being Willing That the Error (if any) [122] Should in due manner
be Corrected and full and Speedy Justice Done to the Said Partys in this
