Debt Costs and Damages afsd then or Yet in no sort being satisfied, And the
Afsd Francis further Saith that the same Debt Costs and Damages then and
for Severall months Afterward there were of the value of the said Sum of
Eighty four pounds fourteen Shillings and two Pence sterl: Money of Great
Brittain And that the afsd John Afterward and Before the Impetration of the
Writt in this Action there Dyed, And that the Afsd Richard Willis him hath
Survived, by Which Action hath Accrued Unto the afsd Francis to Demand
And have from the afsd Richard Willis the Afsd Eighty four Pounds fourteen
shillings and two Pence Sterling money of Great Brittain Nevertheless the
afsd Richard Altho' often required the Afsd Sums of Tobacco or Any Pound
thereof or the afsd Sum of Eighty four Pounds fourteen Shillings and two
Pence Sterl: or Any Penny thereof Unto the same Francis hath not rendered
But that unto him Hitherto to render hath refused and Still Doth refuse
Wherefore he saith that he is the worse and hath Damage to the Value of
One Hundred Pounds Sterling and thereof he brings the Suit etc:
PI etc: Jno Doe and Richd Roe
And the afsd Richard Willis by Joshua George his attorney Comes and
Defends the force and Injury When etc: And Prays Leave to imparle here-
unto untill Next Court And he hath it And the Same Day is Given to the
Plantiff Alsoe.
At which said Next Court To Witt the i6th Day of May Anno Dom: 1727
Come Again the said Parties Plantiff and Defendant by their Attorneys afsd
And the said Defendt by his said Attorney Prays further leave to Imparle
hereunto Untill next Court And he hath it And the same Day is Given to
the PIf1 also.
At which said next Court To Witt the 17b Day of October Anno Dom:
1727 Come again the said Parties Plantiff and Defendant by their attorneys
afsd And the Said Defendant by his said attorney prays further leave to Im-
parle hereunto Untill Next Court and he hath it And the same Day is Given
to the Plantiff Alsoe [824] At which said next Court To Witt the 21st Day
of May Anno Dom: 1728 Comes again as well the said Francis Skirvin by his
attorney Afsd As the said Richd Willis by his Attorney Afsd And the said
Richd Willis by his said Attorney as before Defends the force and Injury
When etc: And Prays a hearing of the Writt afsd which is read Unto him in
these words.
MARYLAND ss: Charles Absolute Lord and Propry of the Provinces of
Maryland and Avalon Lord Baron of Baltemore etc: To the sherriff of Dor-
chester County Greeting We Command You that You take Richd Willis late
of Dorchester County Genl One of the Coroners of the same County if he
shall be found in Your Balywick And him safe keep So that you have his
body before the Justices of Our Provll Court to be held at Annapolis the
Third Tuesday of October Next to Answer Unto Francis Skirvin of a Plea
