sumption of him the Said William Hopkins did Bargain Sell and deliver unto
him the Said William diverse Goods Wares and Merchandizes att Sundry
rates and prices in Tobbacco and also did Give Creditt to Severall persons
for Severall Summs of Tobbacco Amounting to the Sume of five Thousand
Six hundred and Twenty pounds of Tobbacco as aforesaid and although the
Said Willm Hopkins [93] did afterwards pay unto the Said Thomas Tench
the Summe of three Thousand Two hundred thirty Six pounds of Tobbacco
yet as to the Summe of Two Thousand three hundred and Eighty four
pounds of Tobbacco residue of the Said Summe of five thousand Six hundred
and Twenty pounds of Tobbacco he the Said William Hopkins According to
his promise and Assumption af^d to the Said Thomas Tench hath not paid
although Often thereunto required but the Same to him to pay hath denyed
and as Yet doth deny Whereupon the Said Thomas Tench Saith he is Damni-
fyed and hath Loss to the Value of four thousand pounds of Tobb^a and there-
upon he brings his Suite.
