Anywise Erred And Likewise Prays that his Said Lordships Court of Appeals
and Errors here Proceed to the Examination As Well of the Record And
Process Afores^t As of the Matters Aforesaid above for Error Assigned And
that the judgment afores^d in Every thing May be affirmed But because his
Said Lordships Court of Appeals And Errors here of rendering their judg-
ment of and Upon the Premisses Are not as Yet advised Day is thereof Given
to the Parties Afores^t Before his Lordships Governour and Council afores^d
from the said Sixth Day of February at the City afs^d Untill the fifteenth Day
of May Being the third Thursday of the same Month Ann domini Seventeen
Hundred and twenty Nine to hear their judgment of and Upon the Premisses
for that his Said Lordships Court of Appeals here thereof Are Not as Yet
advised. At which said 15^th Day of May last Mentioned Before his Lord-
ships Governour and Council afores^d Sitting as a Court of Appeals and Errors
at the City afores^t Comes the Parties aforesaid by their Attorneys Aforesaid
Whereupon all and Singular the Premisses by the Court being Seen and fully
Understood and Diligently Examined and Inspected As well the Record and
Process afores^t And the Judgment thereupon rendered As the Causes and
Matters Above by the Same Michael for Errors Assigned for that it Seems
to his Lordships Court Now here that neither in the Record and Process
afores^t Nor in rendering the judgment afores^t It is In any Wise Erred And
that Record in Nothing Vicious or Defective in Law It is Therefore Consid-
ered that the judgment Afores^t in Every thing be affirmed And stand in its
full force and Effect the afs^t Causes and Matters for Errors above Assigned
in Any wise Notwithstanding And it is further Considered by his Said Lord-
ships Said Court Now here that the Said Thomas Brooke Recover of the
said Michael Macnemara two thousand [816] Four Hundred and Ninety
Six Pounds of Tobacco to the Said Tho^s Brooke by the Court now here of
his assent adjudged According to the form of the Statute thereof lately made
and Provided for his Costs and Charges Sustained by reason of the Delay of
the Execution of the judgment aforesaid by Pretext of Prosecuting his said
Lordships Writt of Error And that the said Thomas Brooke have thereof
Execution etc: Whereupon afterwards on the twenty first Day of May Anno
Dom: Seventeen hundred and twenty Nine in the same Court or Terrae the
said Michael Macnemara Present in Court Prays an appeale from the judg-
ment of this Court So as Afores^ll rendered to his Majestic and Council Which
is Granted on Giving Security to Prosecute the said Appeale with Effect Sav-
ing Nevertheless his Lordships Right And Ordered by the Court that it be
Entered by way of Protestation Against the said Appeale in the Manner
Wherein it is Prayed.

Whereupon the said Mich^l* Macnemara With Charles Carroll of the
City of Annapolis Gen^l And Charles Carroll of the City Afores^t Chirurgeon
this Day Enter into Bond in the Penal Sum of two Hundred Pounds Ster-
