directed by Act of Assembly.

On Appeale It is the Opinion of this Court that the writt of Sc fa ad
audiendum Errores is Erronious In that that it is Set forth in the Said Writt:
Whereas John Digges Lessor of Tho^s Nelson hath Appealed etc: Whereas it
ought to have been Said Whereas Tho^s Nelson Lessee of John Digges hath
appealed.

John Digges Lessee v John Beale

It being Moved this day and the Question being put that notwithstand-
ing the Writt of Scire facias ad audiendum Errores Was Erronious as the
Defendant in Error appeared and pleaded to issue whether the Error in the
Scire facias was Material or not: The Court delivered their Opinion that it
was not Material.
