4ly That after the Defts Adams and Brewerton had Agreed about the
Land the Sd Adams promised Hannah Waltam at John Waltams to pay all
the Cost the Sd Brewerton Should be put to by the Compll if the Sd Brewer-
ton would be ruled by him the Dept further Saith that at the Time the Deft
Brewerton was at the Depts house the Dept was Overseer to the Deft Adams
and was to have the Room that Brewerton keept by Agreement.

Isaac Noble of Stepney Parish in Somersett County aged about 43 years
Sworn and Examined on the part of the Deft Saith as followeth Vizt.

This Depont remembers that about 3 years past Mr Adams tendered Wm
Brewerton Tobacco for the Land the Said Brewerton Sold the Sd Adams and
the Said Brewerton refused the Sd Tobo except Mr Caldwell would Accept
of also that MT Adams desired Wm Brewerton to Send for Captn John Jones
and Mr John Roach to Settle the affairs in dispute between the Defts and to
Take in the Second deed but this Dept Cannot be positive whether it was
the first or Second also if the Sd Brewerton wanted any of his Swamp he might
have it

Robert Smith of Stepney Parish in Somersett County aged 28 years
Sworn and Examined on the part of the Defts Saith as followeth Vizt

This Dept heard Mr Adams use many Arguments to Wm Brewerton to let
Mr Caldwell have the Sd Land the Sd Brewerton Said to the Sd Adams if you
will not have the Land he th Dept will Sell it to Some body else before
the Dept goes home for Mr Caldwell a Scotch bonny laubber Son of a
bitch Should not have it about the Last of the Same year that Mr Adams
had reced the Sd Wm Brewertons Cattle this Depont heard the Sa Adams
Say after that Time that he the Said Adams had no right nor Title to the Sa
Cattle

[770] Peter Sherman of Stepney Parish in Somersett County aged 52 years
Sworn and Examined as followeth Vizt.

This Dept being one of the Jury of Inquiry of Damages in Debate be-
tween the Compll Caldwell and the Deft Adams Mr Caldwell brought his
Acctu wch was for one Thousand pounds of Tobo wch the Jury allowed but five
hundred pounds of Tobo.
