574 MARYLAND COURT OF APPEALS

That upon the Execution of the Writt of Elegit mentioned in this Depts
Deposition for the Compll he desired Mr Adams to Deliver him the Goods he
had in his possession of Wm Brewerton and that Mr Adams Answered he
ha [sic] a Bed and Silver Cup woh Wm Brewerton brought there and refused
to deliver them Wm Brewertons Goods but told him he might Take them
if he Would this Dept never heard of any writt of Elegitt being Executed in
this County before the Writt mentioned by this Deponant and further
Saith not

Wm George of Stepney Parish in Somersett County Sworn and Examined
on part of the Deft Saith as followeth Vizt.

That at Wm Harries house he Signed as an Evidence to a Bond passed
from Mr Adams to Wm Brewerton Likewise one from Wm Brewerton to Mr
Adams not both Signing one Bond they were then going to Mr Thomas
Dashiell and further Saith not

John Handy Levin Gale:

John Scott of Somersett Parish in Somersett County Sworn and Ex-
amined on the part of the Def" Saith as follows Vizt.

This Dept being one of the Jurors he heard the Sherriff ask Mr Adams if
he would deliver the Goods Wm Brewerton brought to his house as the Goods
of the Sd Brewerton and refuse to Deliver them as the Goods of Brewerton
but Said he might take them if he would he Should have them and that he
did not hear the Sd Adams Claime any part of the Goods of Sd Brewerton the
Jury thought that the 200 Ibs of Tobo was allowed for the yearly rent of the
Land and that it would Come out of the Sume that was then there mentioned
wth out Interest and the Said Adams told the Sherriff that was his Land and
that his Line run as the fence run and that Mr Caldwell Acknowledged Adams
first Deed for One hundred and Sixty Acres to be good

Thos Benson of Stepney Parish in Somersett County Sworn and Ex-
amined on the part of the Defts Saith as followeth Vizt.

This Dept heard the Sherr Ask Mr Adams if he would deliver the Goods
of Wm Brewerton that he Carried to his house and the Sa Adams Said there
was a bed he might have it and that the Jury thought the 200 Ibs of Tobo
was allowed for the yearly Rent of the Land and that it was to Come out of
the Sum that was then mentioned without Interest.

Solomon Turpin Stepney parish in Somersett County Aged 29 years
Sworn and Examined on the part of the Deft Saith as follows Vizt

That he happened once at Mr Adam's When Wm [768] Brewerton was
there and Mr Adams used Severall Arguments wth him to persuade him to
persuade him [sic] to let Mr Caldwell have his Land but Sd Brewerton
Cursed and Swore that Mr Caldwell never Should have it and Desired Mr
