MARYLAND COURT OF APPEALS 549

by the said Court of Appeales and Errrs that the afd Daniel Bryon recover
of the said Prior Smallwood one hundred and twenty pounds Sterling and
five thousand Six hundred and Seventy pounds of tobacco Damages which
he Sustained by occasion of the Breaking the Covenant afd As also It is Con-
sidered by the said Court that the said Daniel Bryon recover of the sd Prior
Smallwood two thousand one hundred and Seventy three pounds of toba to
the Sd Daniel Bryon by the Court now here of his Assent adjudged for his
Costs and Charges in the Court Laid out and Expended and that the Sd
Daniel Bryon have thereof Execution etc.
[742] The Court Adjourns till 3 of the Clock afternoon
The Court meet According to adjournment and present as Before Noon
Certificate of Mr Georges having taken the Oath of an Attorney filed Who is
thereupon Admitted to Practice

The Court Adjourns till to Morrow morning

Friday July the 5th 1728. The Court meet According to Adjournment
Present as Yesterday

Governour and Council of the Province afd Sitting as a Court of Appeals and
Errors the following appeale made by Charles Carroll by Wm Beckingham
his Attorney from the Judgmt of the Provl Court afd the Tenour of Woh fol-
lows in these words Vizt

Amongst other Things is Contained as follows Vizt

MARYLAND sst At a Provinciall Court held at the City of Annapolis in
the County of Annarundell for the Province of Maryland on the Third Tues-
day in May being the Sixteenth day of the Same Month in the Twelfth year
of the Dominion of the Rt Honrble Charles absolute Lord and proprietor of
the provinces of Maryland and avalon Lord Baron of Baltemore etc. An-
noque Dom 1727

Were Present: The Honrble Thomas Addison; Wm Lock; John Smith; Philip
Lee, Esqrs Justices.
