MARYLAND COURT OF APPEALS 539

MARYLAND sst At a Provinciall Court held at the City of Annapolis in
the County of Annarundell for the Province of Maryland on the third Tues-
day in May being the Sixteenth day of the Same Month in the Twelfth year
of the Dominion of the Right Honrble Charles absolute Lord and Proprietor
of the Provinces of Maryland and Avalon Lord Baron of Baltemore etc: An-
noque Dom 1727

[E:J:] Daniel Bryon v [D:D:] Pryor Smallwood

Provl Court May Term 1726.

CHARLES COUNTY ss. Be it remembred that Heretofore To witt the
Eighteenth day of May Anno Domini 1725 Pryor Smallwood of Charles
County Planter otherwise called Pryor of Charles County in the Province of
Maryland Gent was Summoned to answer unto Daniel Bryon of a plea that
he hold to him the Covenants between them made According to the force
forme and Effect of Certain Indentures between them made

And Thereupon the Said Daniel by Edmond Jennings his Attorney
Saith that whereas by Certain Indentures made in Charles County afd the
Ninth Day of August in the year of our Lord One Thousand Seven hundred
and Twenty between the Said Pryor Smallwood by the name of Pryor Small-
wood of Charles County in the Province of Maryland Gent of the One part
and the Said Daniel Bryon by the name of Daniel Bryon of Stafford County
in the Colony of Virginia Planter of the other part which Said Indenture
Signed with the Seale of the Said Pryor and by the Said Daniel here into
Court Brought whose Date is the Day and year afd Wittnesseth that the Said
Pryor Smallwood as well in Consideration of the Sum of One hundred and
Twenty Pounds Sterling of Great Brittain in hand paid by the Said Daniel
Bryon unto the Said Pryor Smallwood before the Sealing and Delivery of
those presents The receipt whereof the Said Pryor Smallwood did thereby
Acknowledge and himself therewith to be fully Satisfyed Contented and paid
and of from every Part and parcell thereof did fully Clearly and Absolutely
Exonorate Acquitt and Discharge [733] The Said Daniel Bryon his Heirs
and Assigns for ever as for Divers other good Causes him thereunto moving
hath Bargained Aliened Enffeofed Sold and Confirmed and by Virtue of the
Said presents did Bargain Alien Enffeof Sell and Confirm unto the Said
Daniel Bryon his heirs Exrs Admrs and assignes for ever all that parcell or
Tract of Land whereon John Godshall formerly dwelt Called Saint Bridgett
Lying in Charles County on the West Side of Portobacco or Sf Thomas Creek
in the woods Originally taken up for John Cain as by a particular might Ap-
pear Begining at a Bounded Oak Standing by the Side of a Branch Side near
to Old Bounde Oaks and running from the Said Oak for North the length
