482 MARYLAND COURT OF APPEALS

[678] Which being read and heard I'ts ordered that a full Transcript of the
Proceedings afd be Transmitted to the High Court of Appeals pursuant to
the Prayer and Appeale afd of the Said William Rogers

In Testimony whereof the Seale of the Provl Court is hereunto Affixed
this day of November Anno Dom 1725.

Afterwards To Witt the thirty first Day of May Anno Dom Seventeen
hundred and Twenty Six before his Lordships Court of Appeals and Errors
at the City of Annapolis Comes the Said Wm Rogers by Michael Macnemara
his Attorney and the Said Wm Rogers Saith that in the Record and process
and in rendering the Judgment afd It is Apparently Erred. It is Erred in this
That the Judgment afd is rendered for the Said Thomas Against the Said Wil-
liam Whereas by the Law of the Land Judgment ought to have rendred for
the Said William Agt the Said Thomas For Which With many other Errors
as well in the Record and process as in the rendring of Judgment afd the Said
William prays that the Judgment afa may be Reversed and held as (Vicious)
And that he to all he thereby Lost may be restored etc.

On Which Said thirty first Day of May afd Before his Lordships Court
of Appeals and Errors at the City afd Comes Likewise the Said Thomas Bord-
ley in his own proper person and Saith that neither in the Record nor in the
process afd nor in the rendring the Judgment afd it is in any thing Erred and
Prays that the Court of the Lord proprietor here may proceed as well to
Examine the Record and Process afd as the matter afd above for Error as-
signed and that the Judgment afd may in all things be Affirmed

But because his Lordships Court of Appeals and Errors now hereof ren-
dering of their Judgment of and upon the premisses and not advised day is
thereof given to the parties afd Before his Lordships Governour and Council
afd untill the ist Thursday of June next being the Second Day of the Same
Month to hear their Judgment of and upon the premisses for that his Said
Lordships Court of Appeals and Errors now here thereof are not yet advised.
Att which Said first Thursday of June Anno Dom Seventeen hundred and
Twenty Six Before his Lordships Governour and Council Sitting as a Court
of Appeals and Errors at the City of Annapolis afd Comes as well the Said
Wm Rogers b} his Attorney afd as the Said Thomas Bordley in his proper
person Whereupon as well the Record and process afa and the Judgment
thereupon rendered as the afd matter for Error Assigned by the Said W"1
Rogers by the Court here being Seen and fully understood and Mature De
liberation being thereupon had it Seems to his Lordships Court now here
