his Debt afd as also the Sum of Nine hundred and Thirty five Pounds of To-
bacco by the Court here adjudged unto him for his Cost and Damages Sus-
tained by Occasion of Detaining the Same Debt And the Defendant in
Mercy etc.

Whereupon the Said William Rogers by his Attorney afd Prays an Ap-
peale from the Judgment of this Court So as afd rendered Against him to the
high Court of Appeals of this Province which is granted upon giveing Secur-
ity for the Due prosecution thereof According to Law

Whereupon afterwds in the Same Court or term the Said William Rogers
Together With Thomas Cockey Patrick Sympson Mordecai Hammond Rob-
ert Gordon James Govane and John Cockey his Sureties enter into the follow-
ing Bond for the due prosecution of the Appeale afd According to Law Vizt

MARYLAND ss. Know all men by these presents that wee William Rog-
ers Thomas Cockey Patrick Sympson Mordecai Hammond Robert Gordon
James Govane of Ann" County Gent and John Cockey of baltemore County
Gentleman are held and firmly Bound unto Thomas Bordley Esqr in Two
Thousand Eight hundred and Eighty Pounds Sterling and Three Thousand
Pounds of Tobacco to be paid to the Said Thomas Bordley his Ex™ Admrs
Assigns or Certain Attorney to the which Payment well and truly to be made
and Done We bind our Selves our and every of our heirs Executors and Admrs
Joyntly and Severally in the whole and for the whole firmly by these presents
Sealed With our Seals and Dated this two and twentieth Day of October
Anno Dom 1725

The Condition of the above Obligation is Such That Whereas the above
Bounden William Rogers hath appealed from a Judgment of the Provl Court
rendred for the above named Thomas Bordley against the Said William
Rogers for fourteen hundred and forty Pounds Sterl Debt and Costs of Suit
to the High Court of Appeals Now if the Said William Rogers Shall prose-
cute the Said appeale with Effect According to the directions of the Act of
Assembly in Such Cases provided And also Satisfie and pay to the Said
Thomas Bordley his Exrs Admrs or Assigns in Case the Said Judgment Shall
be Affirmed as well all the Debt Cost and Damages adjudged by the Provin-
cial Court as afd As also all Cost and Damages that Shall be awarded by the
High Court of Appeals Then the above Obligation to be Void and of none
Effect Else to be and remain in full force and Virtue
