Mr Joseph Hill Aged about 49 years being Sworne on the holy Evange-
list of Almighty God Declared on his Oath to the Severall Questions as fol-
lows (Vizt) Question. Did you know Wm Seward Deceased reputed
Son of George Seward Deced. Answer. He Did Question What
Doe you know of a tryal in the Provl Court upon an Ejectmt brought by Wm
Seward agi Thomas Hicks and after what manner the tryal was managed and
the behaV of Coll Thos Smithson then Chief Justice of the Said Court.
Answer. Says that on the tryall of the Said Cause he was present in Court
and that the Said Smithson [660] as the Said Sewards Attorneys was pleading
to the Court and Jury Severall [sic] threatned the Said Attorney to Sylence
him and at Last Said he would Strike the Said Attorney if he did not hold his
Talking and Thos Taylor one of the Jurors Sworn to try the Sd Cause Said
(upon the plfts Calling an Evidence to the barr to be Sworn) that he thought
he had heard Evidences Enough upon Which the Defendt Demra and the Jur-
ors thereupon Discharged from rendering their Verdict in the Said Cause
Question What Do you know in relation to a bill proposed to be brought
in by Coll Thos Smithson Deced then one of the Delegates for Talbott
County in Relation to Cutt of [sic] Peoples Rights that held Lands above 20
years without patients granted them Answer. That he was in the assem-
bly when the Said Coll Thos Smithson did propose a bill to be brought in
as afd and in favour thereof made a Long Speech but the Said proposed Bill
was rejected and that as well the Said Depo as Severall others then Members
of the Said Assembly thought the Said Smithson had a Designe in proposing
the passing Such a bill as afd in order to Debarr the Said Sewards right from
the Land in Dispute. Mr Jno Brannock aged about 50 years being Sworne
on the holy Evangelist of Almighty God Declared on his Oath to the Severall
Questions hereafter mentioned proposed on part of the Complts as follows
Vizt Question What do you know in relation to Coll Thos Smithsons
treating with Wm Seward in relation to the purchase of the Land in dispute
in the Minority of the Said Seward Answer Sayes that the Said Coll
Thos Smithson offered the Said Seward one other Tract of Land in Exchange
for the Said Land in Dispute and other Valuable Consideration but the Said
Seward did not Except thereof being under Age.
