402 MARYLAND COURT OF APPEALS

ships Said Court Now here that the Said Thomas Gassaway recover of the
John Gresham Daniel Dulany and Thomas Humphrys pounds to
the Said Thomas Gassaway by the Court here now of his Assent adjudged
According to the forme of the Statute thereof Lately made and provided for
his Costs and Charges Sustained by reason of the Delay of the Execution of
the Judgment aforesaid by pretext of prosecuting his Lordships Writt of
Error and that the Said Thomas Gassaway have thereof his Execution etc.

Powlson Appeale from the Provincial Court; [D:D:] John Smiths Exrl v
[TB] John Contee's exrs Appeale from the Provl Court; [D.D] Kenelm Skil-

Frisby Ex" of James Frisby v [TG] William Frisby Appeale from the Provl
Court; [D:D:] Jonathan Forward agt [T:B:] Gilbert Powlson Appeale and
Transcript from the Chancery Court; [DD] John Bush v Daniel Walker Les-
see of Thos Robins Appeale from the Provl Court. The aforegoing Six
Causes Stand Continued till next Court.

The Court adjourns till the fourth Tuesday of February Next.

[608] At a Court held Before his Excellency the Governour and his Lord-
ship's Honourable Councel for hearing Appeals and Writts of Error held in
the Councel Chamber At the Port of Annapolis on the tourth Tuesday of
February being the Twenty fifth day of the Same Month Anno Domini
1723.

Present: His Honour Charles Calvert Esqr, the Governour; Col William
Holland; Col Thomas Addison; Col Richard Tilghman; Col M. Tilghman
Ward; Benjamin Tasker Esqr.

The Court adjourns till to Morrow morning Nine of the Clock Wednes-
day Febry 26th 1723 The Court meet According to Adjourment Present as
Yesterday

The Court Adjourns till to Morrow morning 9th of the Clock. Thurs-
day Febry 27th 1723 The Court Meet According to Adjournment. Present as
Yesterday.

Frisby's Exrx v Wm Frisby

It being Alledged by Mr George of Council for Wm Frisby in an Appeale
brought Against him by Ariana Frisby Ex" of James Frisby that the appeale
is abated he the Said George in Court declares he will not insist on the abat-
ment [sic] but desires the Cause may be Continued untill next Court under a
rule of being then heard which is agreed to on the other Side and the Cause
continued Accordingly

The Court Adjourns till to Morning Nine of the Clock Friday Febry 28th
1723 The Court meet According to Adjournment. Present as Yesterday
