384 MARYLAND COURT OF APPEALS

[589] In Records and proceedings of the Provincial Court of Maryland

Amongst other things is Contained as follows Vizt

At a Provinciall Court held at the City of Annapolis in the County of
Annarundell for the Province of Maryland on the third Tuesday of Septem-
ber [590] being the 16th Day of the Same Month in the third year of the
dominion of the Right Honble Charles absolute Lord and proprietor of the
provinces of Maryland and Avalon Lord Baron of Baltemore etc. Annoque
Dom 1718.

Were Present: The Honble Col William Holland Cheif Justice; Col Saml
Young; Col Thos Addison; Col Richd Tilghman; James Harris Esqr; James
Stoddart Esqr, Justices. Soon after appeared Col Thos Smith

[T.M:] John Gresham v [T:B:] Thos Gassaway

MARYLAND sst Thomas Gassaway late of Annarundell County Gent
Otherwise called Thomas Gassaway Gent of the County of Annarundell
Sheriff was Summoned to answer unto John Gresham of a plea that he
render unto him the Sum of five hundred Pounds Sterl good and Law-
full money of England which to him he Oweth and Unjustly detaineth
etc.

And Whereupon the Said John Gresham by William Bladen his Attor-
ney Saith that whereas the afd Thomas Gassaway the Twentieth day of Oc-
tober in the year of our Lord God One Thousand Seven hundred and Eleven
at Annarundell County by his Certain Writeing obligatory Acknowledged
him Self to Stand and be firmly bounden and obliged to the Said John
Gresham in the Said five hundred pounds Sterling to be paid to the Said
John Gresham when he Should be afterwards thereunto required Neverthe-
less the Said Thomas the aforesaid Sume of five hundred pounds Sterling
altho often required to the Said John Gresham as yet hath not rendered but
the Same to him to render hitherto hath refused and Still doth refuse to the
Damage of the Sd John Gresham five hundred pounds Sterling and there-
upon he brings the Suit etc. and he brings here into Court the writing
Obligatory aforesaid which the Debt aforesd in forme aforesaid doth Testifye
Whose date is the day and year aforesaid etc.

And the Said Thomas Gassaway by Thomas Bordley his Attorney Comes
and Defends the force and Injury when etc. And prays Oyer of the Writing
Obligatory aforesaid and it is read unto him he also prays the hearing of the
