that he Should Make known unto the Said Samuel Howard that he Should
be and appear in the Said high Court of Appeals to be held at the City of
Annapolis on the first Tuesday of May being the Seventh day of the Same
Month Anno Domini Seventeen hundred and Twenty three to hear the
Errors assigned upon the Judgment aforesaid if to him it Should Seem meet
and the Same day is given to the Said Samuel Howard also. At Which Said
first tuesday of May Anno Domini Seventeen hundred and Twenty three
before his Lordships high Court of appeals aforesaid at the City of Annapolis
aforesaid Comes as well the Said Edmond Benson Lessee of the Said Henry
Sewell by his Attorney af^d as the af^d Samuel Howard by Michael Howard his
Attorney and the Sherriff aforesaid did not the Writt And thereupon the
Said Edmond Benson the Lessee aforesaid as before Saith that in the Record
and process aforesaid as also in rendering the Judgment aforesaid it is mani-
festly Erred Alledging the Errors aforesaid by him the Said Edmond Benson
in forme aforesaid above alledged and prays that the Judgment aforesaid for
the Errors aforesaid and others in the Record and process Aforesaid [587]
being May be reversed Annulled and altogether held for None and that he
to all things which by Occasion of the Judgment aforesaid hath Lost may
be restored and that the Said Samuel Howard to the Errors aforesaid Re-
joine and that his Lordships Court of Appeals and Errors here will proceed
to the Examination as well of the Record and process aforesaid as of the Mat-
ters aforesaid above for Errors assigned. And the Said Samuel Howard Saith
that Neither in the Record and process aforesaid nor in the Matters therein
Contained nor in Rendering the Judgment aforesaid it is in any wise Erred
And Likewise prays that his Said Lordships Court of Appeals and Errors
here proceed to the Examination as well of the Record and process afore-
said as of the Matters aforesaid above for Errors Assigned And that the
Judgment in everything may be affirmed But because his Lordships Court of
Appeals and Errors here of rendering of their Judgment of and upon the
premisses are not as yet advised Day is thereof given to the parties aforesaid
before his Lordships Governour and Council from the Said Seventh Day
of May Seventeen hundred and Twenty three at the City of Annapolis afore-
said Untill the third Tuesday of July being the Sixteenth day of the Same
Month Anno Domini Seventeen hundred and Twenty three to hear their
Judgment of and upon the premisses for that his Lordships Court of Appeals
and Errors here thereof are not as yet advised

At Which Said third tuesday of July Anno Domini Seventeen hundred
and Twenty three before his Lordships Governour and Council Sitting at
a Court of Appeals and Errors at the City aforesaid Comes as well the Said
Edmond Benson by his Attorney aforesaid as the Said Samuel Howard by
his Attorney aforesaid. And Whereupon all and Singular the premisses And
the Matters therein Contained by the Court here being Seen and fully
