374 MARYLAND COURT OF APPEALS

year of the Dominion of the Rt Honble Charles Absolute Lord and Pro-
prietor of the Provinces of [576] Maryland and Avalon Lord Baron of Balte-
more etc: Annoque Domi 1722.

Were Present: The HonMe Collo Samuel Young Cheii Justice; James Stod-
dart Esqr; William Lock Esqr, Justices. Henry Lazenby Sherriff; Vachel Den-
ton Clk.

[D:D.T.B.] Edmond Benson lessee of Henry Sewell v [MH.,] Samuel Howard

MARYLAND sst Samuel Howard late of Annarundell County Planter
was Attached to Answer unto Edmond Benson of a Plea wherefore with force
and Arms into one Dwelling house and three hundred and twenty Acres of
Plantable land called Warner neck near the River Severn Begining at a
marked Oak in a hollow near a Creek called Warner Creek and running
West by the Creek for the length two hundred Seventy five perches bound-
ing on the West with a line drawn North from the end of the West line for
the Length of Ninety five perches to a marked Oak on the North with a line
Drawn East and by South into a Cove called Bustians Cove and with the said
Cove on the South East with the said Creek and River Containing and laid
out for three hundred and twenty Acres lying in Annarundell County afd
which Henry Sewell to the said Edmond Benson demised for a term which
is not yet past hath Entered and him from his farme afd hath Ejected and
other harms to him hath done to the great Damage of him the said Edmond
and against the peace etc:

And Whereupon the same Edmond Benson by Thomas Bordley his
Attorney complains that whereas the aft Henry the first day of October in
the year of our Lord God Seventeen hundred and twenty at Annarundell
County afd did Demise to the afd Edmond Benson the afd house Land and
Premisses with the Appurtenances To have and to hold the same unto the
said Edmond and his Assignes from the twenty nineth day of September
then last past untill the end and term of five Years from thence next following
and fully to be Compleat and Ended By Vertue of which Demise the same
Edmond into the [577] afd house land and premisses with the Appurtenances
Entered and was thereof possessed and the same Edmond being so thereof
possessed the afd Samuel afterwards to Wit the same first day of October
Anno Domi: Seventeen hundred and twenty afd with force and Arms etc:
into the afd house Land and premisses with the Appurtenances which the
same Henry to the Same Edmond in form afd Demised for the term afd
which is not yet past Enter'd and him from his farm afd Ejected and other
harms to him hath done to the great Damage of the said Edmond and against
the peace etc: Wherefore he says he is the worse and hath lost to the Value of
two hundred pounds Sterling and thereof he brings the Suit etc: Pledges etc:
