Daniel and Elizabeth Exrx as afd by their Attorney a? And the said Daniel
and Elizabeth by their Attorney afd say That the said Attorney Generall the
Action afsd against them to have or [556] Maintain Ought not because they
say that the said Thomas Dent Continued in the Execution of the Office of
Sherriff of Charles County from the day of the Date of the writing afsd untill
the 13th day of August Anno Domi 1712 and no longer (to witt at Charles
County afd and that all the time afd he the said Thomas did well and truely
serve her late Majesty Queen Ann in the Office of high Sheriff of Charles
County afd and did render unto the said late Lady the Queen, And other
her Officers a true faithfull and perfect Account of All and Singular her
said Majesty's rights and Dues and to her Officers a true and Just Account
of their Fees he was intrusted with by the said late Lady the Queen's Gover-
nour and other her Officers within this Province to receive and Collect and
his Accounts to the said late Lady the Queen And her Governour for the
time being for all the fines forfeitures and other dues belonging to the said
late Lady the Queen and her Governour And also his Account of all fees dues
and other summs of money or Tobacco for Levys or Fees due to any Officer
or Other the good People of this Province that did require the same did pass
an Account of before the tenth day of April in the Condition of the Writing
af? mentioned (to witt) at Charles County afd and in all other things as
Sheriff of Charles County afd did behave himself well and honestly towards
all Persons according to the best of his power skill and knowledge And the
said Daniel and Elizabeth Exrl as afd further say that the said Thomas Dent
hath well and truely Observed preformed fullfilled and Kept all and Singular
the Articles Conditions Clauses and things in the Condition of the said Writ-
ing Specifyed on his part to be Observed and Kept And this they are ready to
verifye and therefore they pray Judgmt if the said Thomas Bordley Esqr the
said Action against them to have or maintain Ought etc.
And the said Attorney Generall of the said Lord Proprietor for the said
Lord the King saith that by any thing prealledged from maintaining the
Action afd he Ought not to be barred because protesting that the said Thomas
Dent hath not Observed performed fullfilled or kept any the Articles Condi-
tions Clauses or things in the Conditions afd Specified for plea he saith that
the said Thomas Dent Continued Sheriff of Charles County after the thir-
teenth Day of August Anno Domi Seventeen hundred and twelve in the Plea
afd [557] mentioned to Witt untill the twenty sixth day of June anno Domi
Seventeen hundred and fourteen at Charles County afd And the sd Attorney
Generall further saith that on the thirteenth Day of Aug31 Anno Domi Seven-
teen hundred and twelve afd and Long before a Certain Philemon Lloyd of
Queen Anns County Esqr was and ever after untill the tenth Day of July
Anno Domi Seventeen hundred and fourteen hath Continued One of her
late Majesty's Officers Viz: Deputy Secretary of State within this Province to
Witt at Charles County And the said Attorney General further sayth that the
