County in the Province of Maryland Gent otherwise Called John Rogers of
Charles County in the Province af^d Gent: were Summonsed to Answer unto
Thomas Bordley Esq^r his L^dships Attorney Gen^tt who for the Lord the King
that now is in this behalf prosecuteth of a plea that they render unto the said
Lord the King two hundred thousand pounds of good Sound Merchantable
leaf Tobacco and Cask which from the said Lord the King they unjustly
detain etc.

And Whereupon the same Thomas Bordley his L^dships Attorney Gen^a
who for the said Lord the King that now is Prosecuteth Sayth, That whereas
the aforesaid John Rogers in his Life time the thirteenth day of August in
the year of our Lord God Seventeen hundred and twelve at Annarundell
County by his certain Writeing Obligatory did Acknowledge himself to be
holden and firmly bound unto her late Majestic Queen Ann of Great Brit-
tain etc: in the af^d two hundred thousand pounds of Tobacco to be paid
unto the said Queen her heirs and Successors when afterwards he should be
thereunto required Nevertheless the said John Rogers in his life time or the
afs^d Elizabeth after the Death of the said John Rogers while she was Sole or
the af^d Daniel Junifer and Elizabeth after the marriage between them Cele-
brated altho often required the af^d two hundred thousand pounds of To-
bacco to the said Lady the Queen or to the now Lord the King have not
rendred but the same to the said lady the Queen or to the now Lord the
King hitherto to render have refused and the af^d Daniel Junifer and Eliza-
beth the same to the said Lord the King to render still do refuse and unjustly
detaine to the Damage of the said Lord the King four hundred thousand
pounds of Tobacco and this the said Thomas Bordley for our said Lord the
King is ready to verifye etc: and he brings hereinto Court the writeing Ob-
ligatory af^d which testifies the Debt af^d in form af^d whose date is the Day
and year abovesaid.

And the Daniel and Elizabeth Ex^rx as aP by Daniel Dulany their Attor-
ney Come and Defend the force and Injury when etc: and pray [554] a
hearing of the writing Obligatory af^d which is read unto them they also pray
a hearing of the Condition of the same writing Obligatory and it is read unto
them in these words following Viz^t: The Condition of the above Obligation
is such that if the above bounden Thomas Dent do well and truely serve her
said Majestic her heirs and Successors in the Office of high Sherriff of the
County of Charles within the Province af^d and also shall render unto her
said Majestic and other her Officers a true faithfull and perfect account of
all and Singular her said Majesty's Rights and Dues and to her Officers a
true and Just Account of their fees that he shall or may be intrusted with
by her Majesty's Governour and other her Officers within this Province to
receive and Collect and his Account to her said Majesty her heirs and Suc-
cessors and to her and their Governour there for the time being for the fines
and forfeitures and other dues belonging to Her said Majesty's as also his
