Cockey and William Rogers both of Annarundell County came hereinto
Court and Acknowledged themselves to owe and Stand Justly Indebted to
the said Gilbert Powlson in the sum of Nine hundred pounds Sterling to be
Levyed on their and either of their bodys goods or Chatties Lands or Tene-
mants Joyntly and Severally to the use of the said Gilbert in Case the said
Jonathan Forward doth not prosecute the said Appeale with Effect and pay
unto the said Gilbert all Costs and Charges that shall be Adjudged to the
said Gilbert in Case the said Judgment shall not be reverst.
The following Letter was preferrd to the Honb}e the High Court of Ap-
peales by Mr Daniel Dulany on behalf of Mr Jonathan Forward.

Being informed Mr Bordley Objects to the Security
proposed for the prosecution of Mr Forwards Appeal [e] to the King and
Councill I begg leave to inform your Honrs that there is already such se-
curity as the Chancellor approved off in twelve or fourteen hundred pounds
Sterling for the prosecution of the appeale from the Chancery to your Hon™
that their is Security given in above twelve hundred pounds Sterling by Mr
Cockey for the prosecution of his Appeale from the Provinciall to your
Hon™ all which relates [548] to the money now in Dispute, besides which
the Bills of Exchange themselves which are unquestionably good, are pro-
posed to be lodged as a further Security in this Honble Court, all which Clr-
cumstances considered I submitt to your Hon™ whether there be any reason-
able Cause to Object to the Security proposed and am

Also the following Petition was then preferr'd.
To the Honble the High Court of Appeales. The Petition of Jonathan
Forward Merchant in London. Most humbly sheweth That one Gilbert
Powlson Commenced his Action in the Provinciall Court of Maryland against
your Petitioner and recovered Judgment for Six hundred pounds Sterling
and six thousand and odd pounds of Tobacco and attached Six hundred
pounds in the hands of Thomas Cockey your Petitioners Agent for which
sum the said Cockey was taken in Execution and Obliged to give bills of
Exchange That your Petr being able (as he doubts not) to prove that the
said Powlson had by a suit which he Commenced in the Admiralty Court
against your petitioner got into his hands more of your petitioners Effects
than would discharge his the said Powlson's Just Claimes Applyed to the
HonMe William Holland Esqr late Chancellor of Maryland for a rule to stopp
the said Bills of Exchange in the Sherriffs hands untill your Petitioner Could
be heard in Equity upon your petitioners giving good Security. That your
Petitioner gave Security and Exhibitted his Bill in Equity which was Dis-
