And the afs^d Jonathan Forward prays his L^dships Writt to forewarne the
said Gilbert Powlson to be before his said L^dships Governour and Councill
at Annapolis to hear the record and process afs^d and it is granted unto him
therefore Comand is given to the sherriff of Annarundell County that he
should make known to the af^d Gilbert Powlson that he shou'd be before us
in our high Court of Appeales to be held at the City of Annapolis the third
friday of July then next being the twenty first day of the same [543] month
to hear the Record and process af^d if to him it should seem meet and the same
day is given to the same Jonathan Forward also.

At which said twenty first day of July before his L^dships high Court of
Appeales afs^d at the City of Annapolis afsaid Came as well the af^d Jonathan
Forward by his Attorney af^d as the afs^d Gilbert Powlson by Thomas Bordley
his Attorney And the Sherriff afs^d did not send the writt af^d And thereupon
the said Jonathan Forward as before sayth that in the Record and process
af^d as also in the rendring the Judgment afs^d it is manifestly Erred Alledgeing
the Errors af^d by him the said Jonathan in forme af^d above Alledged and
prays that the Judgment af^d for the Errors af^d and others in the Record and
process af^d being may be reversed Annulled and altogether held for none
and that he to all things which by Occasion of the Judgment af^d he hath lost
may be restored and that the said Gilbert Powlson to the Errors af^d Rejoyne
and that his said L^dships Court of appeales and Errors here will proceed to
the examination as well of the Record and process afs^d as of the matters afs^d
above for Errors Assigned. And the af^d Gilbert Powlson sayth that neither
in the Record and process af^d nor in the matters therein Contained nor in
rendering the Judgm^t af^d it is in any wise Erred And likewise prays that his
said L^dships Court of Appeales and Errors here proceed to the Examination
as well of the Record and process afs^d as of the matters afs^d above for Errors
Assigned And that the Judgm^t af^d in every thing may be Affirmed. But be-
cause his said L^dships Court of Appeales and Errors here of rendring there
Judgm^t of and upon the Premisses are not as yet advised day is thereof given
to the Parties af^d before his L^dships Governour and Councill af^d untill the
twenty first day of July next.

At which said day Before his L^dships Governour and Councill afs^d Sit-
ting as a Court of Appeales and Errors at the City of Annapolis af^d Comes as
well the said Jonathan Forward by his Attorney afd as the said Gilbert Powl-

peales and Errors now here of their Judgm^t of and upon the premisses to
render are not as yet advised further day is given as well to the af^t Jonathan
