In the Records and proceedings of the High Court of Appeales for hear-
ing Appeales and Errors before his Hon^r the Gov^rn and his L^dships Hon^ble
Councill within this Province according to an Act of Assembly in that Case
made and provided amongst other things is thus Contained Viz^t:

MARYLAND ss^t At a Court held before his Hon^r Charles Calvert Esq^r
Gov^rn and his Lordships Hon^ble Councill for hearing Appeals and writts of
Error on the Seventh day of May being the first Tuesday of the same month
in the Eighth year of the Dominion of the Right Hon^ble Charles Absolute
Lord and Prop^ry of the Provinces of Maryland and Avalon Lord Baron of
Baltemore etc: Annoque Domi Seventeen hundred and twenty three.
Present: His Hon^r Charles Calvert Esq^r Governour; The Hon^ble John Hall
Esq^r; Samuel Young Esq^r; Coll^o Thomas Addison; Phillemon Lloyd Esq^r;
Coll^o Richard Tilghman; Coll" Mathew Tilghman Ward; James Bowles
Esq^r and Benjamin Tasker Esq^r, of the Honble Councill.

Heretofore to Witt as it appears in the Records and Entrys of this Court
to Witt the i8^th day of April Anno Domi Seventeen hundred and twenty One
The R^t Hon^ble the L^d Propry hath directed to his L^dships Justices of the
Prov^ll Court his Writ Close which follows in these words.

MARYLAND ss^t Charles absolute L^d and Propry of the Provinces of
Maryland and Avalon L^d Baron of Baltemore etc, To our Trusty and Well
beloved Samuel Young Esq^r our Cheif Justice of our Province of Maryland
and his Associates Justices of our Provinciall Court Greeting Because as Well
in the record and process and rendring Judgment as in awarding Execution
thereon in a Certain [532] Plea of trespass upon the Case which was in our
said Court before you and your Associates by our Writt between Gilbert
Powlson Marriner and Jonathan Forward late of the City of London Merch^t
als diet Jonathan Forward of Annarundell County Merch^t Manifest Errors
(as it is said) hath happened to the great damage of the said Jonathan For-
ward as of his Complaint We have received We being Willing those Errors
if any there be shou'd be duely Corrected and full and Speedy Justice in this
Part be done to the Partys afs^d Comand you that if Judgm^t be thereupon
rendred and Execution awarded that then the Record and Process af^d with
all things touching the same under your hands and Seales distinctly and
Openly you Send and this Writt so that they may be had before our Gov^rn
and Councill in our High Court of Appeales to be held at Annapolis the
twentyth day of this Instant That the Record and Process af^d being inspected
our Said Governour and Councill may further do therein for the Correcting
those Errors what of right and According to the Custome of this Province
