MARYLAND COURT OF APPEALS 337

in the Port of Annapolis on the first tuesday in May being the Seventh day
of the same month Anno Domi Seventeen hundred and twenty three.
Present: His Exny Charles Calvert Esqr GoVn; The Honble Samuel Young
Esqr; Coll" Thomas Addisson; Collo Richard Tilghman; James Bowles Esqr,
of his Ldships Honble Councill.

The Court adjourns till to morrow morning Eight a Clock Wednesday
May the 8th 1723. The Court meet According to adjournmt
Present: His Exlly Charles Calvert Esqr Governour; The honMe Saml* Young
Esqr; John Hall Esqr; Coll" Thomas Addison; Collo Richd Tilghman; James
Bowles Esqr and Benj" Tasker Esqr.

[516] [T.B.] Ariana Frisby Exrx of James Frisby Deced v John Snow

Heretofore as it appears by the Records and Entries of this Court to
Witt on the twenty Sixth day of March in the Sixth Year of his Lordships
Dominion etc. Annoque Domi Seventeen hundred and twenty the Rt Honble
the Lord Propry hath directed to his Ldships Justices of the prov** Court his
Writt Close which follows in these Words.

MARYLAND sst Charles Absolute Lord and Propry of the Provinces of
Maryland and Avalon Lord Baron of Baltemore etc: To our trusty and
well beloved Samuel Young Esqr Cheife Justice of our Provinciall Court
Greeting Whereas in the Record and Process and Also in Rendring Judgmt
of a Plea which was before William Holland Esqr late Cheif Justice of our
said Court and his Associates Justices of the same Court by our Writt between
John Snow and James Frisby lately deced Concerning that That he should
render unto him the said John his reasonable Account of the time he was
Baliffe of the same John and Receiver of the Goods of the same John at
Gambia that is to say in Annarundell County in the Province of Maryland
etc. Manifest Errors as it is say'd hath happened to the great damage of Ariana
Frisby late Wife of the said James and Exri of the Testament of the said
James as of her Complaint we have received And in Retardation of the
Execution of the same Testament We being Willing that the Error if any
their be shou'd be duely Corrected and full and Speedy Justice be [517] done
to the said Parties in this behalf Command you that if Judgmt be thereof
Rendered etc: Then the Record and process afsd with all things thereunto
Relateing to our Governour and Councill within our Province of Maryland
under your Seale Distinctly and Openly you send and this Writ so that We
may have the same before our said Govrn and Councill at our high Court of
Appeales to be held at Annapolis the twentyth day of April Next that in-
specting into the Record and process afst We may further Cause to be done
for the Correcting that Error what of Right and According to the Laws and
customs of this our Province of Maryland shall be to be done Wittness our
