is thereof given to the parties afsd before his Ldships Governour and Coun-
cill afsd from the said third day of November at the City of Annapolis afd
untill the third day of April next Anno Domi Seventeen hundred and
twenty two to hear their Judgmt of and upon the premisses for that his said
Laships Court of Appeales and Errors here thereof are not as yet Advised.
At which said third day of April last mentioned Before his Ldships Gov-
ernour and Councill afa Sitting as a Court of Appeales and Errors at the
City afd comes as well the said Richard Bennett by his Attorney afd as the
said Peregrine Frisby by his Attorney aforesaid.
[481] And whereupon all and Singular the premisses by the Court now
here being seen and fully understood and deligently examined and inspected
and mature deliberation being thereupon had. It appears to his said Ldships
Court of Appeales and Errors now here that in the Record and Process afd
and likewise in rendring the Judgmt afd it is manifestly Erred.
Therefore it is Considered by the said Court that the Judgmt afll as to
the said Richard Bennett for the Errors afsd above Assigned be revoked An-
nulled and altogether held for None And that the said Richard Bennett to
all thing that thereby he hath lost may be restored etc.
And also it is Considered by the Court here the same day and year that
the said Richard Bennett recover against the said Peregrine Frisby surviving
Admrs afd the sum of pounds of Tobacco to the said Richard Bennett
by the Court here adjudged for his Costs and Charges by him upon the prose-
cution of the said Writt of Error laid out and expended and that the said
Richard Bennett have thereof his Execution etc.
Memorandum the same Day Daniel Dulany Esqr of Councill for the
Appealees pray'd an Appeale from the Judgment of this Court to the King
and Councill Which was granted to avail so fair as in Law it may.

Was presented to his Excellency the Governour and his Lordships Honour-
able Council.
To his Excellency the Governour and the Honourable Council of Mary-
land. The Humble petition and Appeale of John Ward of Cecil County
Gent. Most Humbly Sheweth That one Nathaniel Hynson a Minor by Na-
thaniel Hynson of Kent County Gent his next friend in the year of our Lord
1716 Exhibited his Bill of Complaint into the High Court of Chancery
against your petitioner Setting forth That John Hynson father of the Said
Nathaniel the Minor was Seized in Fee of five hundred Acres of Land called
the worlds End Originally granted to one Francis Child about the year Six-
