Assigned upon the Judgm^t af^d if to him it Should Seem meet And the same
day is given to the said Richard Bennett also.

At which said fourth thursday in September being the 22^d day of the
same month Anno Domi Seventeen hundred and twenty Before his L^dships
Court of Appeales af^d at the City of Annapolis af^d Came as well the af^d
Richard Bennett by his Attorney afs^a And the Sherriff of Cecill County To
Wit James Vanbeber Gen^l returned that by Vertue of the Writt af^d to him
directed by George Douglass and Hugh Wattson good and lawfull men of
his balywick he did make known to the said Peregrine Frisby that he should
be before us in our High Court of Appeales and Errors at the day and year
af^d at the Port of Annapolis af^d to hear the Record and process af^d if to him
it should seem meet as by the writ af^d he was Commanded which said Pere-
grine Frisby [478] According to the premonation to him in this Part made
by Daniel Dulany his Attorney And whereupon the said Richard Bennett
as before saith that in the record and process afs^d as also in rendring the
Judgment af" it is manifestly Erred alledging the Errors af^d by him the said
Rirharrl in form a£^d alledged and prays that the Judgment af^rt for the Errors
af^d and others in the record and process af^d being may be reversed Annulled
and altogether held for none and that he to all things w^ch by Occasion of the
Judgm^t af^d he hath lost may be restored and that the said Peregrine Frisby
to the Errors afs^d rejoyne And that his said L^dships Court of Appeales here
will proceed to the examination as well of the Record and process af^d as of
the matter af^d above for Errors assigned.

And the af^d Peregrine Frisby that neither in the Record and process nor
in the matters therein Contained nor in rendring the Judgm^t af^d it is in any
wise Erred and likewise Prays that his L^aships Court of Appeales and Errors
here proceed to the examination as well of the Record and process afs^d as of
the matters above for Errors Assigned And that the Judgm^t af^d in every thing
may be Affirmed.

But because his L^dships Court of Appeales and Errors here of rendring
there Judgm^t of and upon the premisses are not as yet Advised day is thereof
given to the parties af^d before his L^dships Gov^rn and Councill af^d untill the
fourteenth day of October then next Anno Domini Seventeen hundred and
twenty.

At which said day before his L^dships Gov^rn and Councill af^d Sitting as
a Court of Appeales and Errors at the City of Annapolis af^d comes as well the
said Richard Bennett by his Attorney af^a as the said Peregrine Frisby by his
Attorney af^d But because his L^dships said Court of Appeales and [479] Errors
now here of their Judgm^t of and upon the premisses to render are not as yet
advised further day is given as Well to the af^d Richard Bennett as the afs^d
Peregrine Frisby from the said fourteenth day of October at the City of An-
napolis af^d untill the third thursday of April next being the twentyth day of
the same month Anno Domi Seventeen hundred and twenty one to here
