County (to whom the Commission of that Admtion did of right belong) at
Cecill County afs^d in due forme of Law was Committed to them the said
James and Peregrine And the said James and Peregrine further saith that
the said Thomas in his life time altho offten required did not pay the said
three hundred and Nine pounds three shillings and seven Pence Currant
Money but the same and every part thereof at the time of the death of the
said Thomas and the Commision of the Admtion afs^d remained due and un-
paid and which said sum of three hundred and tenn pounds thirteen shil-
lings and Seven pence they retain in their hands for the paym^t whereof the
Writeing afs^d to the said late lady the Queen Stands in full force unsatisfied
and no way Cancelled and the said James and Peregrine further say that the
said Thomas in his Life time (to Wit) the nineteenth day of October Anno
Domi: Seventeen hundred and fifteen at Ann Arundell County by his Cer-
tain Writting Obligatory by him the said Thomas in his Life time then and
there Sealed and as his Act and Deed delivered did grant himself to be holden
and firmly bound unto him the said Richard by the name of Richard Bennett
Merch^t in the full and Just sum of Ninety One pounds fourteen Shillings
Currant money of this Province which same Debt was due unto the said
Richard and not paid by the said Thomas in his life wherefore the said Rich-
ard for the Recovery thereof after the Death of the said Thomas at a Pro-
vinciall Court held at Annapolis in Ann Arundell County the Eleventh day
of September Anno Domi Seventeen hundred and Sixteen sued and im-
pleaded the said James and Peregrine before the Hon^bte W^m Holland Esq^r
and his Associates then Justices of the said Court of and for the said Ninety
one pounds fourteen shillings Current money by the Writt of the Right
Hon^ble the Lord Prop^ry that now is wherein it was so farr proceeded that the
said Richard afterwards at a Provinciall Court held at Annapolis in Ann
Arundell County to witt the Eight day of April Anno Domi Seventeen hun-
dred and Eighteen before the Hon^bfe W^m Holland Esq^r and his Associates
then Justices [474] of the said Court by Consideration of the same Court re-
covered against them the said James and Peregrine by the names of James
Frisby and peregrine Frisby Adm^rs of all and Singular the goods and Chatties
Rights and Credits which were of Thomas Frisby late of Cecill County Gent
deced as well the sum of Ninety one pounds fourteen Shillings Currant
Money as also the sum of one thousand three hundred and two pounds of
Tobacco by the same Court there adjudged to the said Richard for his Costs
and Damages sustained by Occasion of Detaining the same Debt to be levyed
of the goods and Chatties which were of the said Thomas Frisby at the time
of his Death in the hands of them the said James and Peregrine remaining
to be Administred if so much in their hands they had etc: and if so much in
their hands they had not then the Cost of Suit af^d to be levyed of the proper
Goods and Chatties of the said James and Peregrine Whereof they were
Convict as by the Record and Process thereof in the Court here remaining
