MARYLAND COURT OF APPEALS 309

Currant Money of Maryland and no more and that they the said James and
Peregrine have not nor on the day of the Impetration of the Originall Writt
of the said Richard nor ever after had any of the Good and Chatties which
were of the said Thomas at the time of his Death in their hands so to be
Administred besides the said Goods and Chatties to the value of three hun-
dred Sixty Six pounds thirteen shillings and ten pence the said James and
Peregrine say that the said Thomas in his life time to witt the nineteenth
day of June Anno Domi Seventeen hundred [472] and four at Ann Arundell
County by his Certaine writeing Obligatory then and there by him the said
Thomas Sealed and Delivered which the said James and Peregrine with the
Seale of the said Thomas Signed here into Court bring the date whereof
is the day and year afd granted himself his heirs Exrs and Admrs to be held and
firmly bound unto our late Sovereign Lady Queen Ann of Glorious memory
in one thousand Pounds Sterling to be paid to her said Majestic her heirs
and Successors with Condition that if the said Thomas Frisby Admr of all
and Singular the Goods Chatties and Credits of James Frisby Esqr late of
Cecill County deced should make or cause to be made a true and perfect In-
ventory of all and Singular the goods Chatties and Credits of the said deced
appraised in Money and the same so made should Exhibbitt or cause to be
exhibitted into the Office for Probat of Wills etc: at or before the nineteenth
day of September then next ensuing and the Goods Chatties and Credits
should well and truely Administer (Vizt) pay the Debts of the said Deceased
which he did owe at the time of his Decease so farr forth as the same will
extend and the law will Charge and further make or Cause to be made a Just
and True Account of and upon his Admrtion and such part or portion of the
said Goods as should be found remaining upon the said Account Examined
and Adjusted by the Judge Appointed for the time being for Probat of Wills
etc: distribute and dispose as by the said Judge should be limitted and ap-
pointed And lastly should at all and every time and times afterwards Clearly
Acquit discharge and save harmless her said Majesty her Judges and all other
her Officers and Ministers from all persons haveing or pretending to have
any Right title or Interest of in and to the said Goods Chatties and Credits
that then the said Obligation to be void and of no Effect Otherwise to be and
remain and be in full force power and Vertue in Law And the said James
and Peregrine further say that at the time of the Death of the said Thomas
Frisby there remained due and oweing unto them the sum of three hundred
and Nine pounds three shillings and Seven pence Currant Money of Mary-
land to wit at Annarundell County for and in part of their filial portion as
Sons of the said James Frisby Esqr from the said Thomas who [473] Died in-
testate after whose decease to wit the twenty third day of January Anno Domi
Seventeen hundred and fifteen Admrtion of all and singular the goods and
Chatties Rights and Credits which were of him the said Thomas at the time
of his Death by Mathias Vanderheyden Gent: Deputy Comsry of Cecill
