one shilling and five pence and the same so made hath Exhibitted into the
Office for Probat of Wills etc., on the nineth day of August next ensueing
the Date of the Writting Obligatory at Annarundell County which said In-
ventory is a Just and true Inventory of all and Singular the Goods Chatties
and Credits which were of the said Edward Boteler at the time of his Death
and the said Thomas Lingan further saith that he the said Thomas Lingan
hath hitherto from the time of the makeing the said Writeing Obligatory at
Annarundell County afs^d well and truely Administred the said Goods Chat-
ties and Credits Viz^t: did pay the Debts of the said deced which he did Owe
at the time of his decease so farr forth as the said Goods Chatties and Credits
would Extend to and the Law could Charge and hath also paid and Satisfied
all Just fees that were due and Oweing to the Commissary Gen^ll at Ann
Arundell County afs^d and the said Thomas Lingan further Saith that he the
said Thomas hath made a True and perfect Account of and upon his said
Administration one [sic] the nineth day of May Anno Domi Seventeen hun-
dred and nineteen at Annarundell County afs^d and the said Thomas Lingan
further saith that he hath at all times since the makeing the Writeing Obliga-
tory afs^d clearly acquited discharged and saved harmless his said L^dship his
Judges and all other his Officers and Ministers from all persons haveing or
pretending to have any Right title or Interest of in or to the said Goods
Chatties and Credits to witt at Annarundell County afs^d according to the
form and Effect of the Condition afs^d and this he is ready to verifie wherefore
he prays Judgm^t if the said Thomas Bordley Esq^r Attorney Gen^ll as afs^d the
Action afs^d against him to have Ought etc.

And the said Attorney Gen^ll saith that he by any thing prealledged from
haveing and maintaining the Action afs^d ought not to be barred because pro-
testing that the said Thomas Lingan after the probatt of the said Will and
the Administration thereof to him Committed and before the Impetration
of the Originall Writt in this cause did not make nor in the Prerogative
Office Exhibbitt a true and perfect Inventory of the goods Chatties and
Credits which were of the said Edward at the time of his Death as by the plea
afs^d is above Supposed protesting also that divers goods and Chatties which
were of the said Edward to the value of twenty thousand pounds of Tobacco
and more after the Probatt of the last Will and testament of the said Edward
and before the Impetration of the Originall Writt Came [455] to the hands
of the said Thomas which goods and Chatties or any Part or parcell thereof
the said Thomas hath not Administred according to the tenor and Effect of
the Condition of that writeing for plea the same Att^rny Gen^ll saith that the
same Edward in his life time and a Certain Daniel Dulany (to wit) the
thirtyth day of January Anno Domi Seventeen hundred and Seventeen at
Calvert County Accounted together of and Concerning severall quantitys of
Tobacco by the said Edward in his life time towards the Daniel due and
Oweing and then unpaid upon w^ch Accounting the same Edward in his life-
