296 MARYLAND COURT OF APPEALS

[TB.DD] His Ldship v [MH.MJ:] Thomas Lingan

The Justices of the Provll Court of the province of Maryland Transmitt
to his Ldships High Court of Appeales and Errors held before his Extty the
Govrn and his LQships Honbte Councill at the City of Annapolis the follow-
ing Record on an Appeale made by Thomas Bordley and Daniel Dulany
who for us Prosecuteth from the said Provin" Court the tenor of which, fol-
lows in these words (Vizt)

In the Records and proceedings of the Prova Court of the Province of
Maryland amongst other things is thus Contained (Vizt)

MARYLAND sst At a Provinciall Court held at the City of Annapolis in
the County of Annarundell for the Province of Maryland on the third tues-
day of September being the 2oth day of the same month in the 5th year of the
Domn of the Rt Honble Charles absolute Lord and Proprietory of the Prov-
inces of Maryland and Avalon Ld Baron of Baltemore etc: Annoque Domi
1720.

Were Present: The Honble Samuel Young Esqr; Richard Tilghman Esqr;
James Stoddart Esqr; John Mackall Esqr, Justices.
Stephen Warman Sherr. Vachel Denton Clk.

[452] [TB.] His Ldship v [MH.MJ.] Thos Lingan

MARYLAND ss. Thomas Lingan, late of Calvert County Gent: als diet,
Thomas Lingan was Summonsed to answer unto his Lordship the Honble the
Ld Propry of a plea that he render unto him five hundred pounds Sterling
which to him he Oweth and unjustly detaineth etc: And whereupon Thomas
Bordley Esqr his Ldships Attorney GenH who for his Lordship prosecuteth
Saith that whereas the afsa Thomas Lingan the nineth day of May in the year
of our Lord God one thousand seven hundred and Eeighteen [sic] at Annar-
undell County by his Certain Writeing Obligatory did Acknowledge himself
to be holden and firmly bound unto his said Ldship in the afsd five hun-
dred pounds to be paid to his said Ldship when afterwards he shou'd be there-
unto required Nevertheless the afsd Thomas Lingan altho Offten required
the afsd five hundred pounds to the said Lord Propry hath not rendered but
the same to him to render hath refused and Still doth refuse to the damage
of the said Lord Propry one Thousand Pounds Sterling money as afsd and
this the said Thomas Bordley for the said Lord Propry is ready to verifye etc.,
and he brings here into Court the writeing Obligatory afsd which Testifies the
Debt afsd in form afsd whose date is the day and year above said. The Con-
dition of the above Obligation is such that if the above bound Thomas
Lingan Exr of all and Singular the Goods Chatties and Credits of Edward
Boteler late of Calvert County deced do make or cause to be made a true
and perfect Inventory of all and Singular of the goods Chatties and Credits
