The Justices of the Prov^ll Court of the province of Maryland Transmitt
to his L^dships High Court of Appeales and Errors held before his Ex^tty the
Gov^rn and his L^Qships Hon^bte Councill at the City of Annapolis the follow-
ing Record on an Appeale made by Thomas Bordley and Daniel Dulany
who for us Prosecuteth from the said Provin" Court the tenor of which, fol-
lows in these words (Viz^t)

In the Records and proceedings of the Prov^a Court of the Province of
Maryland amongst other things is thus Contained (Viz^t)

MARYLAND ss^t At a Provinciall Court held at the City of Annapolis in
the County of Annarundell for the Province of Maryland on the third tues-
day of September being the 2o^th day of the same month in the 5^th year of the
Domⁿ of the R^t Hon^ble Charles absolute Lord and Proprietory of the Prov-
inces of Maryland and Avalon L^d Baron of Baltemore etc: Annoque Domi
1720.

MARYLAND ss. Thomas Lingan, late of Calvert County Gent: als diet,
Thomas Lingan was Summonsed to answer unto his Lordship the Hon^ble the
L^d Prop^ry of a plea that he render unto him five hundred pounds Sterling
which to him he Oweth and unjustly detaineth etc: And whereupon Thomas
Bordley Esq^r his L^dships Attorney Gen^H who for his Lordship prosecuteth
Saith that whereas the afs^a Thomas Lingan the nineth day of May in the year
of our Lord God one thousand seven hundred and Eeighteen [sic] at Annar-
undell County by his Certain Writeing Obligatory did Acknowledge himself
to be holden and firmly bound unto his said L^dship in the afs^d five hun-
dred pounds to be paid to his said L^dship when afterwards he shou'd be there-
unto required Nevertheless the afs^d Thomas Lingan altho Offten required
the afs^d five hundred pounds to the said Lord Prop^ry hath not rendered but
the same to him to render hath refused and Still doth refuse to the damage
of the said Lord Prop^ry one Thousand Pounds Sterling money as afs^d and
this the said Thomas Bordley for the said Lord Prop^ry is ready to verifye etc.,
and he brings here into Court the writeing Obligatory afs^d which Testifies the
Debt afs^d in form afs^d whose date is the day and year above said. The Con-
dition of the above Obligation is such that if the above bound Thomas
Lingan Ex^r of all and Singular the Goods Chatties and Credits of Edward
Boteler late of Calvert County deced do make or cause to be made a true
and perfect Inventory of all and Singular of the goods Chatties and Credits
