and Singular the Goods Chatties and Credits which were of the said Edwd
Boteler at the time of his Death and the said Thomas Cockshutt further saith
that the said Thomas Lingan hath hitherto from the time of the makeing the
said Writeing Obligatory afsd at Annarundell County afsd well and truely
Administred the said Goods Chatties and Credits (Vizt) did pay the Debts
of the said Deced which he did Owe at the time of his Death so farr forth as
the said Goods Chatties and Credits would extend and the Law Could charge
and hath also Paid and Satisfied all Just fees that were due and Oweing to
the Commissary Genll at Annarundell County afsd and the said Thomas
Cockshutt further saith that the said Thomas Lingan hath made a true and
Perfect Account of and upon his said Admtion on the Nineth day of May
Anno Domi: Seventeen hundred and Nineteen at Annarundell County afsd
and the s* Thomas Cockshutt further saith that the said Thomas Lingan hath
at all times Since the makeing the writting Obligatory Clearly acquitted
Discharged and saved harmless his said Ldship his Judges and all other his
Officers and Ministers from all Persons having or pretending to have any
right title or Interest of in or to the said Goods Chatties and Credits to wit
at Annarundell County afsd according to the forme and Effect of the Condi-
tion afsd and this he is ready to verifye wherefore he prays Judgment if the
afsd Thos Bordley Esqr Attorney Gentt as afsd the Action afsd agt him to have
Ought etc.

[445] And the said Attorney General saith that he by any thing by the afsd
Thomas Cockshutt prealledged from haveing and maintaining the Action
afsd ought not to be barred because protesting that Thos Lingan after the
Probat of the said Will and the Admtion thereof to him Committed and be-
fore the Impetration of the Original Writt in this Cause did not make nor
into the prerogative Office Exhibitt a true and Perfect Inventory of the Goods
Chatties and Credits which were of Edward Boteler at the time of his Death
as by the plea afsd is Supposed, protesting also that he had Goods and
Chatties to the value of twenty thousand pounds of Tobacco and more after
the Probat of the last Will and Testament of the said Edwd and before the
Impetration of the Original Writt came to the hands of the said Thomas
Lingan which Goods and Chatties or any part or parcell thereof the said
Thomas Lingan hath not Administred according to the tenor and Effect of
the Condition of that writeing for plea the same Attorney Gena saith that
the same Edward in his life time and a Certain Daniel Dulanny (to witt) the
thirtyth day of January Anno Domi Seventeen hundred and seventeen at
Calvert County accounted together of and concerning severall quantitys of
Tobacco by the said Edward in his Life Time towards the said Daniel due
and oweing and then unpaid upon which accounting the same Edwa in his
Life time was then and there found in arrears towards the said Daniel in two
thousand fifty and one pounds of Tobacco for the recovery whereof the same
Daniel afterwards (to witt) the seventeenth day of March Anno Domi Seven-
