your Balywick you make known to the Said Charles Carroll that he be and
appear before us in our Said High Court of Appeals and Errors to be held at
the City of Annapolis the twenty day of Aprill next to Shew cause if any he
hath why the Said three thousand four hundred and Eighty three pounds of
tobacco So Decreed as aforesaid of the goods and chatties rights and creditts
which were of the Said Charles Carroll deceased ought not to be executed if
to him it Shall Seem meet And have you then and there this Writt and the
Names of those by whom you make the Same known Wittness our Trustee
and well beloved Charles Calvert Esquire our Capt Generall and Governour
in Cheif in and over this our Province of Maryland this 20th day of October
in the fifth year of our Dominion Annoque Domini 1720

At which Said twentyeth day of Aprill Anno Dni Seventeen hundred
and twenty one Before his Said Lordship at the Port of Annapolis in the
Said High Court of Appeals Came the Said Thomas Wells by Thos Bordley
his Attorney And Stephen Warman High Sherriff of Ann Arundell County
returned, that by Vertue of a Writt to him thereupon directed he made
known unto the aforesaid Charles Carroll to be before his Said Lordship at
the aforesd day and place to do and receive As in the Same Writt calleth and
requireth by John Beale and Michael Pyper two good and lawfull men of
his Baylewick As by the aforesaid precept he was required on the thirteenth
day of Aprill Anno 1721 aforesaid. Which Said Charles Carroll altho' So
Warned and on the Said twentyeth day of Aprill being Solemnly called came
not but made default, Therefore it is considered that the aforesaid Thos
Wells have execution "at his election for the aforesaid three thousand four
hundred and Eighty three pounds of tobacco afd his Costs in the aforesd
Writt mentioned with the additional Cost hereon etc. With Stay of execution
till Munday next.
