Procedendo.

William the third by the Grace of God King of England, Scotland,
France and Ireland defender of the Faith etc: To the Justices of the Provin-
ciall Court in our Province of Maryland Greeting. Whereas George Lingan
Admr of John Abington late of this Province Merchant dec" did humbly set
forth vnto our Govern' and Councill for hearing Appeals and Writs of Error
etc. in Court sitting, to wit, the 9th day of Octobr last past, how that having
obtain'd Judgmt in our s* Provinciall Court against William Parker of Cal-
vert County some time in May preceeding for Seaventy Eight pounds two
shillings and six pence ster. a certain debt for damages vpon a protested
Bill of Exchange together with Six hundred twenty Four pounds of Tobo
Cost of Suit, the sd William Parker did afterwards sue forth a Writ [46] of
Error out of our high Court of Chancery in our sd Province returnable before
our sd Governor and Councill etc: bearing Date the i8th day of June after to
Correct Errors on the sd Judgmt and that the sd Lingan had been served with
a supersedeas for stay of Execution therevpon therefore desired to know if
any such proceedings had been thither transmitted; But forasmuch as vpon
Examination thereon had, no such proceedings had been there Received the
sd Cause was dismissed by our sd Governr and Councill from that Court. We
therefore Command you that vpon the Judgmt aforesd you do proceed to Ren-
der and Award Execution thereon as fully and amply as if the Writ of Error
aforementioned and supersedeas thereon had never been issued; Witness
our Trusty and well beloved Francis Nicholson Esq Chief Justice of our Said
Court and Capt Genll and Governr in Chief in and over our sd Province and
Territory aforesd this first day of December in the Eigth year of our Reign
etc: Annoque Domini 1696.
