On Which said Eighteenth day of Aprill Anno Dom Seaventeen hun-
dred and twelve William Holland Esqr Chief Justice of the Provinciall
Court makes returne of the Writt of Error aforesaid in these Words Vizt
The Record and process of the plea aforesaid Whereof Mention is made
within with all things relating thereto to her Majestys Governour and Coun-
cill within mentiond at the day day [sic] and place within Contained in A
Certain Record to this Writt Annext I send as Within I am Comanded,
Willm Holland Chief Justice
In the Records and Proceedings of her Majesty's Provinciall Court
Amongst other things is thus Contained as followeth Vizt
MARYLAND ss. Att A Provinciall Court held at the Towne and Port
of Annapolis in Ann Arundell County for the Province of Maryland the
first day of Aprill in the Seaventh Year of the reigne of our Sovereigne Lady
Anne by the Grace of God of England Scotland France and Ireland Queen
defender of the faith etc. Annoque Dom 1708.

Thomas Robins agt Renatus Smith and Antho Ivey Executors of Robt
Smith Esqr
MARYLAND ss. Renatus Smith and Anthony Ivey of Queen Anns
County Gentn [277] Executors of the last Will and Testament of Robert
Smith late of Talbott County Gentn deceased otherwise called Robert Smith
of Talbott County Esqr were Sumoned to answer unto Thomas Robins of A
plea that they render unto him the full and Just Summe of Two hundred and
Eighty Eight pounds Currant money of England Which from him they do
unjustly detain.
And Whereupon the Same Thomas by Robert Goldsborough his Attor-
ney saith that Whereas the aforesaid Robert Smith in his life time (that is
to say) the third day of January in the Year of our Lord One thousand Seaven
hundred and five in Talbott County by his Certain bond or Writing Obliga-
tory seald with his Seale and as his Act and deed delivered and here into
Court brought whose date is the day and Year aforesaid he acknowledged
himself to be held and firmly bound unto the aforesaid Thomas Robins in
the full and just Sume of Two hundred and Eighty Eight pounds Currant
money of England to be paid to the same Thomas his Heirs Executors ad-
ministrators or Assignes to which payment Well and truly to be made the
aforesaid Robert Smith bound himself his heires Executors and Administra-
tors firmly by these presents Nevertheless the said Robert Smith in his life
time the aforesaid Sume of Two hundred Eighty Eight pounds unto the
Same Thomas he did not render altho often required And the aforesd Re-
