172 MARYLAND COURT OF APPEALS

against the said Phillip Lynes in the plea aforesaid (as tis said Manifest
Error has happened to the great damage of Walter Storey and Michaell
Martin Executors of the Last Will and Testament of Ann Lynes who was
Executrix of the last Will and Testament of Phillip Lynes Esqr deceasd as
of their Complaint wee have received Wee being Willing that the Error if
any there be be duely corrected and full and Speedy Justice done in this
behalf Command you that if Judgment be thereof rendred then the record
and Process of the plea aforesaid with all things thereunto relating to our
president and Councill of Maryland at Annapolis on the twelfth day of
May next under your hand and Seale distinctly and openly you send and
this writt that the record and process aforesaid being inspected our said
President and Councill may further cause to be done for the Correcting of
that Error what of right and according to law shalbe to be done Wittness our-
self at the City of Annapolis aforesaid this twentyeth day of Aprill in the
13th Yeare of our relgne etc. Annoque Domi 1713.

On Which said Twelfth day of May aforesaid being the day of the re-
turne of the aforesaid Writt the Record and process of the plea in the same
Writt mentiond with all things thereunto relating to her said Majestys
President and Councill of Maryland by William Holland Esqr Chief Justice
of the Provinciall Court of Maryland are sent the Tenour whereof follows
in these Words Vizt

In the Records and proceedings of the Provinciall Court of the Province
of Maryland amongst other things is thus Contained Vizt

Att a Provinciall Court held at the Port of Annapolis the first day of
December in the Eighth Year of the reigne of King William the Third etc.
Annoque Dom [254] One Thousand Six Hundred Ninety Six Att which
day were present of his Majestys Justices of the said Court these following
Vizt:
The Honoble Rob' Smith Esqr; Majr John Hammond.

The King v Phillip Llynes.

MARYLAND ss. Phillip Llynes late of Charles County otherwise called
Phillip Llynes of St Mary's County Gentn was Sumoned to answer unto our
Sovereigne Lord the King One thousand pounds Currant money of England
Which to our said Lord the King he oweth and unjustly detayneth.

And Whereupon George Plater Attorney Gerierall for our said Lord
the King who etc. prosecuteth and saith that the said Phillip Lynes the
Seaventh day of Aprill in the year of our Lord One thousand Six hundred
Eighty eight At St Marys County aforesaid by his certain bond or writing
obligatory sealed with the seale of him the said Phillip and here in Court
produced whose date is the day and Year aforesaid did acknowledge himself
