came the said George Plater Attorny General for our said Lord the King
and prayd Judgment upon the obligation aforesaid And the said Henry
Mitchell by Samuell Watkins his Attorney likewise came who saith he is not
by the said Henry informed of matter sufficient to plead in barr or Avoidance
of the action of their Majestys brought as aforesaid Whereupon it is consid-
ered by the Court here that our Sovereigne Lord the King recover against
the said Henry Mitchell the Sume of One thousand pounds sterling the
penall debt aforesaid and the defendant in mercy etc.

MARYLAND ss. Att A Provinciall Court held at the City of Annapolis
in Ann Arundell County for the Province of Maryland the Second Tuesday
of April being the Fourteenth day of the same Month in the 12th Yeare of
the reign of our Sovereigne Lady Queen Anne etc. Annoque Domi 1713.
Present: The Honoble Colo Thoms Smithson one of the Justices of her Majtys
provinciall Court aforesaid. Jo Beale Clr.
Soon after appeared: The Honble Col Thos Smyth; Robt Bradley Esqr; Samll
Young Esqr, Justices.

Wm Bladen for her Majty agt Grace Mitchell and Daniel Phillips

William Bladen Esqr her Majestys Attorney Genll Sued out her Maj-
estys Writt of Scire facias against the said defendants the tenour of which
follows in these words Vizt

[247] MARYLAND ss. Anne by the Grace of God of Great Brittain France
and Ireland Queen defender of the faith etc. To the Sheriff of Calvert County
greeting whereas at A Provinciall Court of our late dear brother and prede-
cessor William the third King of England etc. held at the Towne and Port
of Annapolis for our Province of Maryland before the Honourable John
Hammond Esqr and his Associates then Justices of the same Court on the
Fifteenth day of May in the Eighth Year of his said Late Majestys reigne etc.
Annoque Domini One Thousand Six hundred Ninety Six our said Brother
and predecessor by consideration of the same Court did then and there re-
cover against the said Henry Mitchell late of this Province otherwise called
Henry Mitchell of Calvert County Gentn the Sume of One thousand pounds
Sterling A certain debt whereof the said Henry Mitchell is Convict Execu-
tion whereof still remains to be done and wee being willing that those things
which are rightly Acted in our said Court should be brought to A due exe-
cution And whereas the said Henry Mitchell is since deceased as by the in-
sinuation of William Bladen our Attorney Generall in our said Province of
Maryland who for us in this behalf prosecuteth Wee have received Command
You that by good and lawfull men of your ballywick you make knowne unto
